Social Security Number for K2

Timeline

My wife's son arrived last week. I went to apply for his S/S number and was told he had to get his EAD first, before a number could be issued. I would be applying for his AOS with EAD included but that will be 4 months before its received in the mail. Has anyone run across this before? Advice? Thanks.

Yes this is correct. Since the EAD (and AP) are free when filed along with the AOS/GC documents, just do it.

Use our recent timeline for recent history of timing.

Baron. Thanks. But the man wants to work now not in 4 months.When my wife arrived she got a stamp at the POE and an S/S card in a week but social security says K2's can't get a social.

POE stamps are a thing of the past and sorry but K2s can't get a SSN until they have the EAD or GC. He will have to deal with it. Them's the rules.

SSA guy is correct... K-2 is not eligible for SSN upon entry like a K-1 is

moving thread as this is not a K-1 visa process issue

ONLY K-1s can get an SSN before an EAD or Green Card. This is ONLY because some jurisdictions used to require an SSN to get a marriage license. K-2s, K-3s and K-4s have never been able to get one until after an EAD or Green Card. The POE stamp is worthless, they are wasting ink to hand it out, but it is easier to give it to everyone and let YOU sort it out than for them to try and sort it out. The stamp is useless without a valid work visa. The K-1 and K-2 are not work visas so there is nothing harmed by giving out the stamp. They gave one to our 13 year old K-2 son when he arrived.

For now, until he has an EAD, he can do volunteer work or go to school.

He IS allowed to wash the car, mow the lawn, clean the gutters...you know, transfer some the "honey do" list to him!

LOL. He has already done the gutters, seeded and fertilzed the lawn but too rainy for the car. But I can be creative.
