I just got the letter from USCIS regarding submitting the 751 to make make my wife's resident status permanent. My wife's current resident card expires on 1/22/11, if I submit the 751 on 12/1 would that be far enough in advance? Thanks for any advice.

Well as of 24 Oct 2010 her 90 day window to apply opens.

If you wait till 1st Dec you SHOULD have plenty of time, but what if it gets lost in the mail? or you wrote the cheque wrong and they send it back? The more time you give yourself, the better your chances of meeting the deadline.

Out of interest I did read of one guy that mailed his in 2 weeks before the deadline. Then he got it back because the cheque was wrong. By the time he sent it back he missed the deadline and they weren't going to accept it... I think he got a letter stating she needed to leave in 30 days... moral of the story, apply ASAP. I waited for AOS because we couldn't afford it at the time and it didn't matter when I applied... when it comes to ROC, I will beg and borrow before I miss that deadline.
