My husband, LPR filed I-130 in September 2010. I want to visit him in December and spend 4-5 months, and am wondering if my case is really completed within the 5 months timeframe, can i stay in the USA and do my interview there? how do i request that my interview be done there instead of in Jamaica?

ALl my previous visits i was given 6 months in the country, so would i be expected to pay for adjustment of status even though i dont think i would be out of status if my interview is set before May 2011 (i would be there, December 2010 -April 2011)?

No. You are only able to interview in your own country; in your case, you can only interview in Jamaica.

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

November 10, 2011: Interview - APPROVED!!!

January 28, 2014: Production of new Green Card ordered

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Naw, this won't work. When the petitioner, your husband submitted the application u were in jamaica and a certain question ask of the applicant is currently in the usa where will he/she have the interview/do the adjustment. Since u were NOT in the usa then the kingston, jamaica consulate was chosen.

When u enter the usa come december you cannot misuse the intended purpose of the visa which is to travel, to visit. because the border officer WILL ask you the reason for your trip you can only say to visit and he still ask when do u plan yo leave. You can't say u will stay because u want to do an immigrant interview in america... You'll probably be denied entry and on the next flight back to jamaica.

after the pending application is adjudicated and if approved would be sent to the nvc. ... You cannot call the m saying you're in the usa. Depending on the visa bulletin your case will/will not be transferred immediately to the nvc .... Especially if they are not processing your p-date/after. When the nvc does get your case file then u can notify them you are in the usa and would like to adjust status at the local office/interview. They will then send your info back to immigration and then only u can submit the necessay forms the 980 & 80 fees. Processing for the adjustment status takes about 4-6 months to be adjudicated and another month to receive the GC. In all reality this takes much longer and is more expensive.

it's a rather high chance you'll be required to return to (your country) jamaica so that an interview etc cam be done. You can't use the privilege of the tourist visa to jump over the immigration process.

Thanks very much for taking the time out to explain so thoroughly. I will spend my time and keep checking the visa bulletin so i can return to JA for the interview.
