Thank you for your post regarding the letters. I'm going through the exact same state of limbo here and the dates I received those letters on are very similar to yours. I'm kind of concerned now because when I last called USCIS, they asked me to disregard the RFE if I have already gone in for the biometrics and that because my case is inside the given time frame, there is nothing they can do about the notice. The person I spoke to did not however confirm whether USCIS received my biometrics for which I believe I should call them in the morning now. This entire process is just horrible. Online Status of my case still shows the RFE they had sent out on November 18th and my case has not been touched since November. Depressing!

It's definitely worth a call I'd say just to ensure things are moving along and not held up because of the phony RFE. That said, some people who received the second notice did nothing and their removal of conditions was approved just fine. I'm surprised every at the California Service Center haven't been briefed on this problem and that every pending case hasn't been checked over to see if it was affected by this issue. It seems strange if they operate a "Do Nothing" approach until contacted by the petitioner. Good luck!

Hey guys, I have a question. I took biometrics on November 22nd, and on November 23rd I received one of those notices that you all are talking about (request to take biometrics again). My online status shows that the last event in my application was "On November 23, 2010, we mailed a notice requesting additional evidence or information in this case..."

Now, I just called USCIS and the guy told me just not to worry because my case is still within the normal processing timeframe.

What I am curious: out of people who got approved, did any of you have the erroneous second biometrics invitation? I think some of you had it, but mailed in copies of paperwork proving that the second notice was erroneous. Have any of you not responded to the second request (i.e. not sent in copies to USCIS) and still got approved?

In our case, NOPE, I never got around to mailing copies of the letters. But we did make the Infopass appointment and initiated the service request... I haven't paid close attention to whether those of us with the letters who have been recently approved all initiated service requests or not - but I would recommend calling and doing that. I was going to do that Monday if I hadn't received the email from USCIS. It's probably not necessary to call but it can't hurt to keep lighting fires under these folks.

It seems like there are a bunch of approvals this week (check the September filers), so fingers crossed that they are on a roll.

Oh - and our online status was not updated until we received the email. It read Last Updated 11/24/10 until after the email when it switched to 1/26/11

Count us as another approved case (after receiving 3 weird requests for a second biometrics!). Approval came through the status update online, today! (can someone update the list for us??)

And, as for us...we never called or started a service request. We did go to an infopass (because we never received the original NOA1 with the extension) and while there they checked and said everything was fine and that there was no documented RFE (ie. nothing was holding up the case). About a month later we got around to sending a letter with a copy of each of the letters and the stamped biometrics noticed to make sure they knew that our case was one of those "weird ones". Don't know if it helped or not...but I am guessing that it wasn't really necessary (since our case was approved with a number of others this week).

So, for what it is worth...that was our story. I think people will be fine :yes: Good luck!!
