I-751 October 2010 Filers

I mailed my forms away to CSC on Oct 24th. Got NOA 2 weeks later...still no sign of biometrics appointment and I'm going to Scotland Feb 11th-27th...going to call monday as that will have been 90days since filing.

well I called....USCIS have LOST my stuff. Check cashed nov 1st then woosh...vanished..gone. GC expires tomorrow. I have my NOA1 and proof check was cashed.

My case status online was changed: On January 21, 2011, we ordered production of your new card.

It had been saying that I'd receive RFE but never came but with two strange bio appointment letters.

and all of a sudden they updated the online status.

So, those of you who are worrying about your RFE online status, no worries. Your cases are in process, I'm sure!!

I just checked our status a few days ago and our case hadn't been touched since 11/24 and then I got the approval e-mail today. I was going to call them today, as our status still said we had an RFE. But nope, we never got one. And the status now reads that card production was ordered.

So - what's up with the VSC? They didn't send out any screwy letters but they also haven't approved any October filers yet? Sucks that all of us are divided into these two camps based on where we live ...

Now, I just called USCIS and the guy told me just not to worry because my case is still within the normal processing timeframe.

What I am curious: out of people who got approved, did any of you have the erroneous second biometrics invitation? I think some of you had it, but mailed in copies of paperwork proving that the second notice was erroneous. Have any of you not responded to the second request (i.e. not sent in copies to USCIS) and still got approved?

I got 3 of those screwy letters, and my status said on Nov. 24 they sent an RFE that I never received. Today I got the email that my card has been ordered. So - I wouldn't worry too much about the letter.

Hi everyone. This is just a heads up in case anyone else received a second I-797C that may have stalled their case without their knowing.

I'd already received my biometrics appointment letter dated 11/1/10 for an appointment on 11/29/10, which I attended and had my biometrics taken on that date, (I received the stamps, etc. on the NOA letter.)

In between those two dates, dated 11/18/10, I received a second NOA stating that "In processing your case we have reached the point where we need you to make an appointment to go to one of our Application Support Centers to have your biometrics taken." As I'd already received the NOA with an appointment date of 11/29 I disregarded this second request assuming that it was just duplicity and that once the biometrics from my original appointment were in the system.

Fast forward a few months and I'm starting to see approvals on these VJ pages, so I thought I'd check the USCIS website and see where I was at yesterday. I was shocked to read this:

"On November 18, 2010, we mailed a notice requesting additional evidence or information in this case CRI89 PETITION TO REMOVE CONDITIONS OF PERMANENT RESIDENT STATUS RECEIVED. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283."

Today, I decided to call USCIS to resolve this matter as it would seem that even though I had my biometrics taken on 11/29, the case was in suspense due to my not making a second biometric appointment -- even though I hadn't even had the first appointment at the date the letter was sent!

The lady I spoke to at USCIS kept stating that sometimes the biometrics need to be taken a second time if there was an issue with them. Despite me explaining several times that at the date of the second request I hadn't even had my first biometrics appointment yet she didn't seem to grasp this fact for several minutes! Eventually after explaining the situation again, she realized her error and placed me on hold to escalate my concerns. The second person I spoke to was initially of the same opinion until he grasped the dates involved, but then put me on hold for several minutes while he sorted things out and promised me that my original biometrics were in the system and unless I had an RFE for further information required there should be no reason why my case can't progress as normal now.

So, if anyone else received a second NOA asking for you to make a biometrics appointment, (before you even had gone for your first appointment), you might want to contact USCIS and make sure they haven't placed your case in suspense for no good reason. (Of course, sometimes a second biometrics is necessary if the original results are indecipherable or lost by USCIS. In my case though, I hadn't even had my first appointment before my case was put on hold due to not having a second biometric appointment!)

I logged on to this thread to post my experience a few moments ago before reading the latest posts.... after posting it I see others are having the same issues! (See my reply #267 above I just posted). Make sure you contact USCIS and explain the situation if you are in the same position -- don't assume it will all fall into place once your biometrics are attached to the case, otherwise your case might be suspended. Thank you for your post regarding the letters. I'm going through the exact same state of limbo here and the dates I received those letters on are very similar to yours. I'm kind of concerned now because when I last called USCIS, they asked me to disregard the RFE if I have already gone in for the biometrics and that because my case is inside the given time frame, there is nothing they can do about the notice. The person I spoke to did not however confirm whether USCIS received my biometrics for which I believe I should call them in the morning now. This entire process is just horrible. Online Status of my case still shows the RFE they had sent out on November 18th and my case has not been touched since November. Depressing!
