We had an Infopass appointment today. My husband is going between the US and Canada lots in the next couple of months and the Canadian customs didn't believe that the piece of paper he has (the NOA) really makes his expired green card valid - so we wanted the I-551 stamp. I didn't realize that it was EITHER/OR. She said she could only give the stamp if he gave up his green card, which didn't seem like a good idea either. Oh well.

We still don't know if we actually have an RFE or not. Our status check said that an RFE letter was mailed out Nov 23 but all we got from that date was two more of those mysterious letters requesting biometrics. We brought this up at our Infopass appointment, so the officer sent a note to the CSC, basically chastising them. The note said these people sent you 65 pages of information, what more could you possibly need? or something to that effect. We'll see if it triggers anything. Supposedly somebody has to respond by December 18.

I called yesterday being in the same boat. The RFE in my case is not traceable on their end i.o.w. it doesn't seem real. Even though I don't have to respond on the bio letters I was advised to send them a copy of the letters and a copy of my original ASC notice. That way, they would be able to see that I'm one of these applicants that has been receiving these letters in error. I expect they will correct this thing after receiving my response.

If you send them this it will at least tell them you haven't received a letter on the issue of your RFE. I assume they'll send you this in case there is a real RF.

That's so annoying ... do they think he's lying about it? Sheesh. Also, does Canadian customs really need to see his green card? I've travelled quite a bit to Canada on my Canadian passport and I never show them my green card. Only once did the Canadians ask if I had a green card, which I showed them. Are they planning not to let him into Canada if his green card is expired? Doesn't really make sense. Not that anything about immigration makes sense! Good luck to your hubby with his border crossings.

I think I figured out that the problem lies in that without an American green card, he needs a visa to enter Canada, so that leaves him in a gray area, according to them. No visa and an "expired" green card with a piece of paper... the IO at our infopass appointment said that there are all new customs regulations (only between the US and Canada, or in general, I'm not sure) and that they are getting used to our system and that hopefully he won't have the problem when he flies again. I'll send more copies of paperwork with him when he goes again...

RE: the biometrics spam letter - ManuFred's suggestion to send copies of everything to the CSC sounds good. I think I'll do that, thanks! And I'm still hoping our "RFE" isn't a real one since it didn't show up in the system either. It's just going to be ridiculously hard to respond to if it comes while we are away for a month.

Another suggestion perhaps :). Bulgeria is now part of the EU, right? In that case he shouldn't have a problem entering Canada with his valid Bulgerian passport. Canada has a similar program as the US' Visa Waiver Program for EU citizens and some other countries. On the way back to US he should of course use his GC in conjunction with the extension letter.

I just called today they said if you dont get ur letter in 30 days u should call. The officer was really nice and told me they arent allowed to tell the exact day of the biometrics but he did tell me the letter will be mailed out this week and the app will be the third week of December. we filed on the same day so maybe yours will be that week as well.

I called the NCSC yesterday and it took me about 30 minutes to figure out how to reach an actual human, once I did she was very friendly. She said that a "request for spouse to be scheduled" has been entered but no biometrics appointment date has been given yet. Apparently the Houston field office is severely backlogged right now. Good news is that nothing got lost in the mail and we haven't missed the biometrics.

Yes I had thought the same thing... but sadly, Bulgaria (and Romania) are the only two EU countries that still require visas to visit Canada.

Completely :ot:, but my husband couldn't even get a tourist visa to the U.S. 3 out of the 4 times he applied - even though most of the EU countries are in the visa waiver program. After we met and he went home, he was denied a tourist visa to visit at Christmas (because he stayed for nearly the full 6 months when he came previously, and they said they assumed he was working) and therefore couldn't apply for another for one year. So he couldn't ever visit me and there are only so many times I could fly there and back with a full time job. So we got married and did the "quick" CR-1 process, which took around 7-8 months. I also quit my job at the beginning of a recession and moved there to wait it out. Man o man our lives would be different if Bulgaria were a VWP country.

Poor Bulgaria.:P

:ot2: No updates or changes in case status. Still saying we have an RFE mailed to us on November 23. grrr. If we have one, I know it's going to arrive while we are away for the holidays.
