Well, I'll be honest, it's been a while since I've visited this forum and made a post.

Actually, I haven't been around much after my wife got her visa and completed the move here to the States. I appoligize for not contributing more, like I used to.

Now it's been almost two years and my wife is leaving next week to visit her mother in Japan.

I just so happened to be updating her flight information on American Airlines website and was entering her Green card number when I saw that the card is set to expire at the end of this month. She will be returning to America on November 25th, well after her card has expired.

So, I've filled out the form and I should have all the documentation together and ready to mail out by tomorrow but I'm waaay past the "mail in 90 days before expiration date".

Is this going to cause problems? Has anyone else run into this before?

Thanks for any advice.

Oct. 20th 2008: Wife, daughter and myself arrive back in America. POE took a whole 10 or 15 minutes.

Oct. 21st - forever: Happy to be with my wife and baby girl.

She will need the NOA1 that extends the validity of her (then expired) green card for 1 year in order to re-enter the US.

Assuming that the submission is correct you should receive the extension letter prior to her return date. You could then FedEx the extension to her so that she can present it at US Immigration.

Hi! I remember your name from before... and we have the same POE date for our spouses...

The only problem I see - assuming you get that NOA1 letter fine and get it to her before she is returning - is the biometrics appointment. Check the previous months filers threads for average time, but it seems that the appointment date averages 7-9 weeks after I-751 submission, so she might or might not get a date when she is back in the U.S. It seems like it is easy to change the date, but if only she can do it, she'll have to send it from Japan. I haven't gotten to that stage yet so I don't know if it's a letter you send back in with a signature or if it's a phone call or what... hopefully someone who knows will weigh in.

If the OP is going to be around, it's not a problem to get the biometrics date pushed back, more than once if necessary. In my case, I asked for six postponements because of travel. To be more precise, I had a family member do it for me six times.

The process is pretty simple. You have to check a box on the appointment letter, mail the original back to the local USCIS office and a copy to CSC/VSC. Make sure you keep a copy for your records. I used certified mail so that I'd have proof that I asked for a postponement.

Ok, maybe a bit of a snag.

I received a packet today in the mail stating

"This Service Center cannot accept your I-751 petition without the proper fee. The base fee for an I-751 is $465 plus a $80 biometric fee for each person included in the petition.

If you have children listed in Part 5 of your I-751 who became conditional residents (CPR) either on the same day as or within 90 days after the CPR listed in Part 1 of the I-751, the child(ren) are eligible to be included in your petition. Failure to submit the biometric fee for any eligible chile listed in Part 5 of your petition will result in removal of that child from your petition. Removal of an eligible child from your petition will result in the termination of status for that child unless a seperate Form I751 is filed for the child with a $545 fee."

So if Im reading this right, it means I just need to mail all this back with the $80 I left out for my child? I didn't think my daughter needed any of this because she already is a dual citizen. Is it just because I listed her on part 5? If so Ill gladly overnight this back to them with an extra 80 bucks. I just want to make sure Im missing something else.

I sent $550.0 money order originally.

I just want to be sure I send the right thing this time. I can't waste anymore time. We are down to 4 1/2 weeks now.

Any help would be great.

Did you send money order for $550.00? It was probably the problem. Fee for I-751 is $545.00.

Just send a check for $545.00 for your wife application and that's it. I don't think listing your child on the form caused any confusion. Children must be listed and there is a part on it where you can write the child's inmigration status.

$465 + $80 = $545.

Maybe it's just as simple that you didn't send them the right amount?

Just a quick update,

Got Ako's NOA yesterday in the mail stating that her resident status has been extended one year! PHEW!!

So it was just that I sent too much money the first time around. I got the notice back really quick too, thank god.

So now I need to get this to her in Japan so she will have it with her when she goes through customs.

I wanna ask you guys advice. Should I send the original or send a copy and then take the original with me when I go to meet her at the airport?

I cant decide which is the smarter thing to do.
