K3 then AOS or K1 then AOS

Good afternoon everyone,

My fiancee and I are getting married in May 2011. We have filed for our K1 (July 2010) now comes the big part. It people's opinion is it better to go back to my home country - Canada - and apply for a K3 Visa and then AOS or should I just do the AOS when I get there after we are married. I know there are many benefits to both sides, but everyone's opinion will be welcomed.

why would you apply for a K-1 only to leave for Canada after your wedding? I read your last post in the K1 section and I guess I'm confused as to what you actually want to do

Hi Canadian_wife,

Thanks for all of your responses. The reason why I am thinking about going to back home after our wedding/honeymoon is because it will allow me to continue to work at my well playing job until my paperwork comes through unlike waiting for my AOS papers to go through without working and relying on my wife's salary.

THanks for the reply. I see the CR-1 and its many benefits. My question is what is the difference between doing an AOS in the USA after getting married and doing a CR-1?

Why complete the K1 process then? You will end up doing the visa process twice in your scenario.

Better to marry and then do the CR1 spouse visa that would allow you to work after entry.
