Hello all,

I read the FAQ and I just wanted to make sure I understood this correctly.

1) I have to send my form before 90 days to the expiration date of my card or else I'm screwed?

My card expires on 01/21/11, so I have about 90 days and 1-2 weeks left?

As long as I file my form before the 90 days, if my card expires before my interview date it's OK?

2) The place for the biometrics exam should be the same one we went to for our green card (2 years ago)?

3) There might not be an interview? If so, where would the interview take place?

Two years ago when I had the interview for green card/AOS approval, I had to go somewhere near Seattle, WA (I live in Vancouver, WA).

Will it be the same place?

4) When do I apply for Naturalization?

On the FAQ it says 3 years after AOS, so basically after this Removal Condition, 1 more year to go?

4/07 - Filed the I-129 F [Petition for Alien Fiancé(e)] Along with Bio forms [G-325a for both of us]

6/07 - Forms got resent back to my Fiance because I forgot to sign some papers. [silly me]

11/28/07 - Got my K1-Packet 3!!! It was a headache to fill in the papers.

2/15/08 - Sent all documents and forms through express! I was close to the expiration date

3/27/08 - Interview letter!!! I was in the US with my Fiance so I couldn't come back in time, rescheduled appointment.

4/24/08 - Got my interview done :) Approved! Passport+visa+brown envelope will be sent within a week.

5/1/08 - Got my Visa!

~ Flying to US on 6/11/08.

~June 19 2008- Married!!!

7/25/08 - Sent in AOS: I-485 along with EAD, AP.

8/7/08 - EAD, AP, AOS touched.

8/19/08 - Got an RFE for I-485... Fixing it.

8/22/08 - Biometrics taken in Portland.

10/08 - Another Bio (for work authorization card).

-- received my work authorization card and advance parole papers in meantime--

1/15/09 - AOS INTERVIEW *faints* in Seattle, Washington.

1) You have to send the form within the 90 days before your card expires. You can't send it after it expires. You can't send it earlier than 90 days. So send it, say, 85 days before your card expires.

2) & 3) I'd think so, but I don't know the area or if anything has changed.

4) Yes, 1 year after removal of conditions. So long as you are eligible (ie haven't been away from the US too much etcetc.)

Your card will expire before you receive your 10 year green card. They will send you a receipt that extends your green card for one more year. You will have to have this with you if you travel or need to renew your driver's licence or something.

Another question, what happens if my card expires and I haven't had the interview yet (paperwork sent but no reply yet)?

Walking around with an expired card would make me feel rather nervous...

You generally receive the receipt within a week or two, so it shouldn't be a problem if you file early enough. Even if there are a few days between your green card expiring and receiving the receipt, it's not something that you would generally be asked about. How many times have you been asked to produce your green card when walking down the street? Besides, anyone with the authority to question you should know all about Removal of Conditions and so know that a 2-year green card that is a few days expired probably means you are still legal... I guess you could carry a copy of the I-751 with you, but seems a little unnecessary. Just try to send off the form with a month to spare!
