My hubby and I are preparing to send out the AOS...the thing is, he lost the I-129F approval notice :wacko: What can I do about that?

I am keeping both last names, mine and hubby's, so when Im filling out the applications, do i write my maiden name under Middle name, or do I put both under Last name?

Do you guys have a photocopy or a scanned copy of the I-129F NOA2?

If you have that, that's all you need for filing the I-485.

You can request for a duplicate approval notice by mailing in an I-824...but it costs $340.

This is DEFINITELY not correct. Sorry.

It is not a legal name change for the OP to make her maiden name her middle name. She would need to obtain a court order to do it, this will REALLY hurt her later if she fails to obtain the court order to change her middle name yet writes it on paperwork. She will need to maintain the two last names as LAST names.

OP as you stated you are keeping two last names, your options are hyphenated, e.g. "Smith-Jones" or not hyphenated "Smith Jones". You would write BOTH names in your "surname/last name" section as they are your surnames. So your name would be Suzie Smith Jones. If you had a middle name like mary, it's Suzie Mary Smith Jones.

As for the NOA2, I would sent the NVC letter and include a letter stating you never received the NOA2. If you want to make it an affidavit that's fine too but I know several people who've done it this way and it's been fine... hope you're able to be one of them.

On the I-485 instructions, it clearly asks for the NOA2 approval notice as proof when you are adjusting as K1...that means the one printed on their official form.

If you have the e-mail notice, you can use the receipt numbers there to apply for the I-824...the average processing time for it is currently 3 months.

You may want to dig in your files for at least one clear photocopy of the I-129F NOA2.

Hmmm either you did or he did, the text of the letter implies he did. It's the one that has your case number on it. For me it was SYD2009XXXXXXXX (I forget how many digits). Your first 3 letters would be your consulate, then the year you received the letter (mine was 2009) and your individual case number. Mine had a barcode on it, I assume yours will too. I'm looking for an example to show you.... here: 1_NVC__letter_K1.jpg They've smudged out some info but does it look familiar?

I don't think there is a problem with using the maiden name as the middle name after marriage. I see it quite often in the US without any court documentation. My daughters both did that. They've dropped their middle names for their maiden names. It would be a problem if she was the former Suzie Mary Smith and filled out her AOS as Britney Paris Jones. But I think Suzie Smith Jones is good. List full maiden name where it asks for other names used.

But I think Suzie Smith Jones is good. List full maiden name where it asks for other names used.

Unfortunately for your daughters, if you try and naturalise them you could be in for a world of pain. Relatively recently (I lose track of time, could be months ago) there was a post from a girl from the Philippines where she tried to naturalise. Her SSN, drivers licence and GC were all in the standard PI form after marriage, their maiden name becomes their middle name, and they take their husbands surname. Because she'd had no issues changing her name on these docs, she naturally (but incorrectly) assumed this was a legal and "okay" change. She filed with this name and was told they could not proceed without documentation of the legal name change of her middle name. Because she'd already filed the paperwork in her "fake" name she had more issues. Her ID was all in the fake name so she had a lot of things to sort out before re-applying for naturalisation (I don't know what she ended up doing).

There was also a post in the last few days where a guy from MN I think it was, changed his surname (his marriage licence/certificate allowed it). Both he and his wife took this same "new" name. USCIS is rejecting it as it's not a court ordered surname change, even though the rules in his state say it's okay (we'll have to wait to see how that works out).

Personally I don't feel it's not worth the risk. THAT, and the OP specifically said that she was keeping her surname, and adding her husbands, thus implying two names as her surname. For what it's worth, hyphenating them seems to cause less issues than not doing so. I would stick with the known legal name (surname only change) and then when (and if) you naturalise there's actually an option there to have them apply for a court order for you. Saves you the expense but you'd have to wait.
