BENEFICIARY'S SIGNATURE ON DS 230 PART 1 FORM

Hey guys,

First time of posting on here since I started my journey in March 2010 for a CR1 visa. All your inputs and comments on this website are always very appreciated.

My case got entered into the AVR as received and under review as on the 13th of September. I have been calling up the NVC on a regular basis just to listen to the AVR and possibly hear the magic words CC but just yesterday morning I called and found out from the AVR a RFE got issused to us on the 28th of September. We hadnt received any email at that time so I deceieded to call back and speak to an operator to find out what documents were missing. While holding on for the operator for about 20minutes I received an email from the NVC advising on the RFE and it was just for one annoying thing.

''In reviewing the form that you submitted, we note that the section pertaining to applicant residences from the age of 16 is

either blank or incomplete. The applicant must list all places lived for at least six months since

reaching the age of 16. There must not be any gaps greater than six months. You will need to

complete and submit a new form with the changes. Your visa application cannot be processed

until this form is complete. A gap exists in your residence history of more than six months''

We actually started from when I was 18 and not 16. we have made the nessessary corrections but the fact is that on the DS part 1 form I am supposed to sign the form.

Two questions:

- Is it ok if my wife signs my signature or just my last name since I am still going to sign when I go for the interview? as the cost of couriering the DS form to her would be very expensive.

- The NVC email about the RFE has come in about 5 times. Do they always repeat the same email or was it just a mistake to send the same email at differnt times of the day.

YOUR SUGGESTIONS WOULD BE GREATLY APPRECIATED

Unfortunately You will have to sign the new ds230 form. I have yet to hear of anyone being able to sign for you except in the case of minor children. I know that the postal fees are expensive sometimes but I do not know any other way around it. There are tons of people online here and maybe someone else will be able to help you with more advice. You have to sign the forms. When I was at my interview, they compared the signatures. If they do that to you, you'd be in a mess if the signatures don't match

Keep your case simple, sign your forms like they ask you to

get the form and sign it,and if your wife is good in signing your signature she can do that .i did that in my own case cos my wife can sign my signature .if your wife cant sign its better you do it your self and she should send the ref cover sheet for you to just send it directly to nvc once signed.

If you are the beneficiary the DS-230 needs to be signed by YOU. You wife cannot and should not sign your name for you!! No one should suggest otherwise.

Signatures should NEVER be forged, no matter how good the other is as signing your signature. Suggesting this is just absurd to me

** Just to clarify what has already been posted in regards to 'signing someone else's name'. While most of us are not legal professionals and do not pretend to interpret the law - it seems reasonable that signing someone else's name on a form (such as is being discussed here) may not be the most legal thing to do.

There is a TOS (Terms of Service) that says:

[will not] Condone or instruct, either directly or indirectly, others on how to commit fraudulent or illegal immigration activities in any way, shape, manner or method.

Please keep this in mind when posting on VJ - this is something we take very seriously and you should too.

I am not a legal professional and I don't know how the USCIS, NVC, or a consular officer would react to this if it was suspected or discovered, but I do know that signing someone else's name with their permission is not considered 'forgery'. It is my understanding that for it to be considered forgery, there must be an intent to defraud.

I also signed my wife's name, with her permission, on some of the documents I submitted on her behalf. In the big scheme of things, you want to minimize risk as much as possible during your visa journey, to make it go as smoothly as possible. But, sometimes circumstances dictate that you take calculated risks.

Well that's an interesting interpretation. I was under the impression that the only legal way to sign for another person was if you had power of attorney. IMO signing for another on government forms (without a legal document allowing you to do so) is a risk I would NOT want to take and to suggest otherwise is not appropriate.

Timeline

If you allow someone to sign for you and at ANY point in the immigration process that document is placed before you and you are asked "is this your signature" you are faced with 2 unpleasant choices. Saying no and possibly having everything that has been approved becoming undone and start all over with a possible charge of misrepresentation thrown in or saying yes untruthfully and getting a charge of misinterpretation and losing all immigration benefits you have gotten. Neither ending is happy. Spend the extra time/money and get the form with the real signature sent to you.

This will not be over quickly. You will not enjoy this.
