Hi all, I'm hoping my unfortunate circumstances don't delay our K1 visa. we received our NOA1 Sept.1st. It's my understanding that after we receive our NOA2 I'll be asked to verify my yearly income with tax returns and show my most recent pay check stubs. Problem is I just was in a serious car accident and will be out of work on short term disability for maybe up to 4 months. Will this slow things down if I can't give them recent paycheck stubs? I can easily verify I have a job and my yearly income. just not sure how much they need or how strict they are. thanks again.

Depends on the embassy you go through.

If you still have a job, and making the income level you need, a letter from the employer will meet the criteria of the I-134. Are you still working?

Some embassies require the most recent tax year return (2009) - so that shouldn't be an issue.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

So far the replies sound good. She lives in The Philippines and yes I'm still employed. My job will always be there. I hope the Manila Embassy Isn't to strict. I would love to find out what the Manila Embassy requires for proof of employment/income from someone who has been through the K1 visa or similar type of visa. Thanks again for such quick replies.

No. If you are on short term disability you have income, show them your disability payments. You also have employment, show them your employment letter. Not a problem.

Here is how it works. You are still employed and lets say you have a job paying $45,000 per year. You are on disability but you are still employed. Employed is NOT the same as working, never forget that. Words mean things. Read carefully interpret literally.

You answer the question "I am ___________________(employed) and derive an annual income of _________________ ($45,000)." Attach last years tax return, a letter from your employer stating your position and income and a bank letter stating your deposits in the last 12 months. Check stubs not needed.

You have answered completely truthfully and detailed your income and supported it. If you think you need to mention the disability (you don't) then expalin it in a letter attached and make sure your employer includes something in his letter that you REMAIN EMPLOYED with that company and AT A SALARY of $xx,xxx per year, and attach copies of disability payments.
