Timeline

Hello.

My mom (LPR) had applied for my brother (her son) visa processing. His case is now @ NVC for processing & we are getting ready to submit I-864 form.

1. My mom doesn't work & lives with me & my husband. She'll fill out I-864 as primary petitioner/sponsor. My husband will be co-sponsor. Should he fill out I-864A (Does he qualify as a household member?). From the I864A instructions, it seems like he doesn't qualify as a household member. Would he have to fill out a second I864 form?

2. What documents should be attached to the forms? I guess my mom won't have any evidence to show & will write ZERO income on primary I864, right? What documents does my husband have to send with the package?

1. He would fill out the 864 (since he doesn't meet the criteria of the 864A)

2. It's listed on the instructions/form - current income tax year return(s) and other evidence to show current income, as needed.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
