Hi guys,

I know that this forum does not condone anything illegal and thats why I am posting because I do not want to do anything illegal.

I have submitted my AOS application and filed for an EAD. I have my biometrics appointment on the 15th October. However I have an interview for a job on the 4th October.

If I get offered the job and the company and I agree a start date for me of, lets say, 1st November and I don't have my physical EAD card in hand but have been told that I am approved and should have it any day, is it illegal for me to work?

Yes it is illegal for you to work without the card.

You may want to try getting your EAD card expedited, based on the fact you have a pending job offer. One of the members, Mathranik, was successful in doing this. Here's a link to his post. http://www.visajourney.com/forums/topic/274608-ead-expedite-successful/

I don't know if you have an SSN or not, but after you get the EAD card, you should be able to get your SSN or have your existing SSN amended to say that you are eligible to work for any US company.

02-23-2018: Date on NOA, retrieved from online account

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!

Ok I thought it might be but I thought there would be no harm in asking.

I doubt it would be worth doing an expedite request seeing as it seems cards are usually with people (judging by the timelines) in about 2 weeks after biometrics. Hopefully if the offer me the job they will be willing to wait for me.

Basically your employer needs to have sent this in: http://www.uscis.gov/files/form/i-9.pdf "no later than the date of employment".. so without your card, you can't technically start working. You could ask them if they mind waiting 2 weeks if you've been approved that is.. because you should get the card by then.

Two things: i am kind of having the same situation that you have, but i have the advantage that I have known my future employer for years... The way that i will get away with it is working as a sub-contractor (i have had my own Company for a while) until the card arrives... Then, after getting my ss they can put me on their payroll... Now, where did you see that it takes about 2 weeks to get the card after the Bios appointment??? I have been looking and what i have seen its the "ead approved" message at about 2 weeks after the bios and then another 2 to 4 to have the actual card in hand...

NO if you don't have a EAD then your "company" would be guilty of illegally hiring a non authorized person. If they hire your company then you would be responsible for verifying your worker in the US was authorized and paying that person SS and medicare. The card will come quickly enough. Don't start your life here by trying to evade the laws.

This will not be over quickly. You will not enjoy this.
