USC filing for married brother and his family

My question for VJ members is, when a USC files for his brother who is married, is his family (spouse and two sons) automatically included in the petition? Or only the brother is included?

The USC will need to explicitly include the derivative applicants in the petition.

spouses and unmarried children under 21 will be included. they are derivatives the brother.

OP, While filing I-130, you will provide their details in q17 and provide the evidence during the next stage of DS-230..Your nephews will be included based on their age and as per the CSPA rules..
