Hello Everyone!!

My name is Iridenisse (yes i know long name and hard to pronounce!) but everyone knows me by Denisse :), I am a Mexican citizen, residing in Houston Tx as an illegal immigrant, my parents brought me here when i was 12 years old, I went to middle school and graduated from High School in 2006 here in the US but unfortunately i couldn't go forward with my education due to not having a social security number I was very dissapointed because it crashed all my dreamns with my future. At this time the only option I had, was to go back to Mexico and continue with college but my boyfriend at that time which we had been dating for 2 years, now my husband Alan, changed my mind! So I decided to stay and we married in August 2, 2007 two months after having our daughter born june 2007, we had our son in july 2008. Finally in 2009 started the immigration process with the help of a lawyer, I-130 was approved and my case was sent to the NVC, now I am gathering paperwork that the NVC will request.

My husband and I are very nervous since I will have to go to Juarez, Mexico for my visa leaving my babies behind :( I was wondering if anyone out there has a similar story to mine that I can relate to, it's hard to communicate with my friends about my situation because most of them are citizens of the US. Thank you and hope to hearing from you soon! :)

So you have about 4 years of illegal presence since your 18th birthday?

Did your lawyer tell you that you will receive an re-entry ban for 10 years when you leave the US?

Due to the ban you will be denied at the interview and required to file a waiver.

Since you EWI (Entered Without Inspection - came illegally) you cannot adjust status from within the US.

If your lawyer hasn't made you aware of the waiver & already started preparing it for/with you then you might want to contact another lawyer.

So you have about 4 years of illegal presence since your 18th birthday? Not 4 years, it has been about 11 years, i basically grew up here in the US, I am now 23 years old

Did your lawyer tell you that you will receive an re-entry ban for 10 years when you leave the US? She stated that it was not up to her, it was up to the officials there

Due to the ban you will be denied at the interview and required to file a waiver. I know about the waiver, yes she told me about it

Since you EWI (Entered Without Inspection - came illegally) you cannot adjust status from within the US. Exactly the reason why i have to leave the US and go to Juarez

Thanks.

Okay, you've been here for 11 years but you don't get punished for illegal presence until you turn 18 so you have 5 years of illegal presence.

Having more than 360 days of illegal presence triggers a 10 year entry ban that starts when you leave the US.

It's not up to your lawyer, the Consulate Visa Unit or even CBP, it is the Law.

Have you started preparing the Hardship Waiver? I would recommend you check-out The Forums at Immigrate2US.net they deal with these kinds of situations on a regular basis. You might even what to look into a Lawyer that hangs around there, Laurel Scott, she specializes in Waivers.
