Hi everyone, got a question about criminal record. I am assembling the I-130 application for CR-1 process at this moment. I have a juvenile criminal record that cannot be sealed due to assault and battery while I was in High School. The I-130 form didn't ask for if I have ever committed a crime. Should I include my juvenile record with the I-130 application??? Will I get an RFE if I don't include my juvenile record??? I am just trying to avoid the RFE. Thanks everyone for your help.

I have a felony conviction from when I was 16 and a misdemeanor as an adult about 14 years later. It has been 10 years since the later charge, I included nothing about either and was processed within normal time without RFE.

provide only what is requested when it comes to your criminal record.. they dont ask so you dont tell.. it really has no impact on a CR1 petition anyway... focus more on showing proof of your relationship in the initial filing so it is all there when it gets to the consulate.. easier to get info into the file now rather than at the interview... show them the big picture dont focus on small things like your record...

The only sort of convictions that would affect a CR1 petition are crimes that fall under the Adam Walsh Act (sexual crimes against children) or crimes involving immigration law. Anything else which is still on your criminal record will be discovered during the background checks, but wouldn't be a cause for denial. I'm not aware of any form you have to file that would require you to mention this conviction, or provide any evidence regarding it.
