Now I have another concern...I just noticed that the police record we sent with our ds 230 expired on january 19, 2011....when they are reviewing our file again...will they request another one? I figured we would have to get updated ones for the interview, but now worried that the expired one will be a problem since our case is still at nvc...the casier judiciare they are stating is wrong doesn't expire til march...

Technically, NVC can request again for the expired docs. You'll need to convince them that you would produce it at interview, if this is the show stopper at NVC. Most probably, they must agree with it. If not, yes, you need to send it again to NVC.

In Inida, some persons who are from a state (Gujrat) will not get Passport office PCC and they have convinced NVC to produce it at interview time. Use the same technique.

thank u, thank u...so last night NVC told my wife we'd hear directly from Montreal and if we dont hear anything by next friday, we need to call DOS. Loto already knows this, I talked to him about it..so I posted this new info for the other's. Damn trip I'm figuring with my medical exam, the drive and hotel and stuff is going to cost me close to near $2000!! ugh.

Since yours is expedited like Richie's and mine at NVC stage, NVC will not schedule the interview now. Consulate will let you know. DOS also will have this information.

I remember trying to use that tactic for the last rfe...and three different operators told me they need to have the physical document before processing our case....supervisor sue told me the same thing....sometimes I feel like I can't catch a break...

I am enjoying some relaxation. Started the day with a body balance class (like yoga-pilates) and now feeling all sorts of chill. Oooh and I baked some banana granola bars, yummy!

Yesterday I was doing my Tax return using TaxAct online. I completed my federal without any problem and then started doing NY State. After completing state, I was all set to e-file my return and I suddenly encountered with "Electronics filling qualification alert". It was saying "This return is not eligible for New York electronics filling. New York state doesn't allow electronics filling for returns when you are married filling joint and only one spouse was a full year resident of New York city or Yonkers. You must file a paper New York return. Click continue to see the next Electronics filling alert". However it was also saying that I could file my federal e-file.

Well you know, for us, it's only one spouse who is the full year resident of state. so how true is that? Should I must paper file my state return? OMG it takes approx 6 + months processing time.

You can use IT-150 or IT-201 which is basically resident tax return for NY.

"Separate returns are required for some married taxpayers who file a joint federal return. If one of you was a New York State resident and the other was a nonresident or part year resident, you must each file a separate New York return. The resident must use Form IT-150 or Form IT-201. The nonresident or part year resident, if required to file a New York State return, must use Form IT-203. However, if you both choose to file a joint New York State return, use Form IT-150 or IT-201."

So, choose her as resident.

This is what we are trying to do. We both are filling joint new york return and I think I was using the Form IT-201. I will have to check again.

This is what we are trying to do. We both are filling joint new york return and I think I was using the Form IT-201. I will have to check again.

Yes, Malvika. You both can use IT-201 as married filing joint return.

Also, check out, you both must have used IT-201 for the year 2009 too.
