What is your priority date in I-130?

Current visa bulletin cut-off of all other countries other than China, DR, India, Mexico and Philippines 01JAN08.

When you call NVC operator now, make sure visa# is already created and assigned to your case. If yes, you don't have to worry.

IV packet will be in the NVC mail to the Consulate - 99.999999999999% :star:

To make it 100%, contact Consulate by phone or email, if it is there, 2 to 3 days after they receive NVC package :thumbs:

My IV package was delivered to NVC on 10/21/2010 and case left from NVC on 11/05/2010. IV package was in NVC mail to the Consulate.

Nowadays, It takes NVC roughly 2 weeks to process received mail into computers. I think your IV was most likely entered into computers in time.

Hopefully, the barcode on the package does play an important role such that NVC can track document in received-->entered-->reviewed stages.

NVC forwarded HoustonApollo's expedited case to Paris only 8 days after IV was received by NVC. Although we don't know what triggered the consulate to send his case back to the US, it's better not the event that NVC entered his IV after the case was forwarded to the consulate. Maybe the consulate was just lazy processing an incomplete package from NVC.

Does this apply to F1 visas, my mom petitioned for my sisters and we just processed the Affidavit of Support, still waiting to send the DS-230, the documents got lost in the mail from Morocco , my sister is sending them again.

I have a question, if you petition for an unmarried son over 21 , and then that person got married, what happen to the petition?

You meant F1 visa to Family based visa - FB visa? (Because there is a student visa too - F1)

Since your mother got Affidavit of Support and Sisters got DS-3032, retrogression does NOT affect this case :thumbs:

Unmarried son over 21 will fall under F2B category and Jan 2011 cut off is 15APR03. They get married after filing I-130 - bit complex :star: Technically, they will move the category from F2B to F3. F3 is even delayed and cut-off is 01JAN01 for Jan 2011.

I'll answer my best way - Since I-130 is already filed before their marriage, there is no way USCIS knows this and they will process under F2B. When it reaches at NVC, if the priority date is current, NVC will assign visa# and send AOS and DS-3032 to the respective parties. Marriage question arises after this point, when IV package is filled out. I really don't know whether NVC will send it to the Consulate or hold it.

In either case, the spouse/child of those sons over 21 years old are NOT eligible to accompany the son. They need separate visa to come to the U.S.

If you are USC petitioner, ignore it completely with an ouch :star:

That thingie is for LPR petitioners.

The reason is visa# is numerically unlimited to USC petitioner's beneficiaries whereas it is limited per year to the LPR petitioner's beneficiaries.

when does AVRS usually changed?? is after mid night or during the day time. I called NVC around 12:30 am mid-night, avrs still played old message, but when i checked in moring like around 5:30am, AVRS changed to documents missing!
