Bad news for F2A filers

The F2A cut off dates per January visa bulletin has heavily retrogressed. This has affected many F2A visa filers who were awaiting for their priority date to be current in January.

It has retrogressed by 2 yrs. and 7 months (approx.)

My NVC Journey

10/12/10 –NVC received the file

10/15/10 -NVC case # generated

10/18/10 -Called NVC and gave both beneficiary and petitioner email addresses

10/19/10 - Beneficiary emailed DS-3032 to NVC and also mailed the hard copy

10/26/10 - Called NVC and got the IIN

10/26/10 - Paid AOS fee $ 88.00

10/27/10 - AOS fee status shows "PAID"

10/27/10 - AOS package expressed mailed (next day delivery)

10/30/10 - IV fee bill generated and paid immediately

10/30/10 - Received AOS fee bill and DS-3032 kit and also received the confirmation of receipt of DS-3032

11/04/10 - IV fee bill status shown as "paid"

11/04/10 - Sent IV package (next day delivery)

11/06/10 - Received IV instructions packet (packet 3) via email

11/08/10 - AOS entered into NVC system

heres my update for the day: NVC? still nothing. USCIS? still nothing. but it seems the predictions were right..the dept. of state requested that the CSC review my case. they can take a minimum of 120 days to do it.

how do i find out what theyre reviewing? is that my senators job? what exactly can my senator do in this situation? can he push them to review? or?..

after its reviewed will it be sent back to the NVC or the embassy?

how long does this usually take? like, some educated guesses/estimates/predictions?

i have no more energy/motivation/ambition. im completely nervous/anxious/desperate/depressed.

im tired of waiting and being patient. i want to conquer this challenge and move on to others, hubby and i together.

im sorry guys, i know im probably really "annoying" right now, but my "VJ family" is really my only place to turn at the moment and i need you guys..

How can i found out if NVC has already processed the case for F2A, Is there any chance to hold up visa interview or anything goes stop to immigrant visa issuing?? Bad news for F2A filers

I understand your feelings and situation. First of all, wish you very best and hope this mess will be cleaned up soon :thumbs:

If the file from the Consulate has been returned back, it can go to NVC for further review or to the USCIS for further review, based on what they are trying to review. For example, if the packet missed a document related to AOS or IV, it can reach back to NVC. On the other hand, if the packet didn't contain any I-130 approval document or background check related document, it can go back to the USCIS.

Since it is still in transit, we don't know where it is going now. In fact, it is not in transit, but it has been already with NVC or USCIS, since it was mailed out on Dec 1 from the Consulate. But, it will be sitting in the mail room and they haven't yet entered into their computer system. Once it is entered into their system, then only they will have any feedback on this matter. Computer entry will be done within 2 weeks of the mail receipt.

After enrty into the system, they need to review it what was requested from the Consulate. The time to review really depends on how simple to complex it is. I still think it will be a simple matter and hoping you or your beneficiary had no prior complex cases such as criminal records, deportation records, overstay records etc. Real simple matter review must be done in another 2 to 4 weeks time by NVC. But the time taken by the USCIS is unpredictable. There is no guess work over there, since USCIS is real black box and the access to them is very very limited unlike NVC.

What you or your senator can do now? Senator has special contact line to USCIS and NVC. So, they can get the meaningful status on the case and to request to expedite the case. To initiate it, at least they must enter your package in the system now.

The United States Department of State (often referred to as the State Department), is the United States federal executive department responsible for international relations of the United States, equivalent to the foreign ministries of other countries. The Department was created in 1789 and was the first executive department established.

The United States Department of Homeland Security (DHS) is a Cabinet department of the United States federal government with the primary responsibilities of protecting the territory of the U.S. from terrorist attacks and responding to natural disasters.

I think there are 14 or 15 departments under President's cabinet. One is Department of State, other is Department of Homeland Security and many more.

NVC, Consulate and Embassies are offices under Department of State (DOS).

USCIS is the office under Department of Homeland Security.

Update F2A:

I just spoke to Supervisor Jenny, She told me that its not they assigned any visa number. Once they have completed whole process and send it to embassy.

I realy didn't understand that. Can anybody tell who assign visa number?? It DOS or NVC? I'm confused now, please help!!!

That's correct, Malvika.

Jan 2011 cutoff for F2A for all other countries (other than those listed) is 01JAN08. It will be effective from Jan.

Dec 2010 cutoff for F2A for all other countries (other than those listed) is 01AUG10.

I don't know at which point in NVC, NVC generates visa# for numerically limited categories.
