If I don't send the original DS-230 and tell them that my wife will bring it to the interview, do you think they would send the case to USEM Nepal without final review? What was happened in your friend's case? Can you please ask him for me?

I just got off the phone with him, He said His wife had AP but it was short period of time. embassy called her after 2 weeks later to collect the passport with visa.

I know your frustration. I would suggest you do it right way. Dont send email, as you see many VJ's got approved their request, probably you gonna get it too. but what happen if your wife receive AP from USEM NEPAL?? or USEM NEPAL send your case back to NVC/USCIS for review? Dont get screw by lazy NVC employee. Just send the original ds-230 which you r going to receive on monday. may be it takes another week delay on your case, but case not gonna send without final review. I wish you best of luck!!!

I know your frustration. I would suggest you do it right way. Dont send email, as you see many VJ's got approved their request, probably you gonna get it too. but what happen if your wife receive AP from USEM NEPAL?? or USEM NEPAL send your case back to NVC/USCIS for review? Dont get screw by lazy NVC employee. Just send the original ds-230 which you r going to receive on monday. may be it takes another week delay on your case, but case not gonna send without final review. I wish you best of luck!!!

Do you know M_B if I also need to send the copy of other documents that was previously submitted with IV package? Or do I just need to send new DS-230 with document cover sheet?

Yeah, but they will have to scan the new DS-230 again and review this one too, right?

I have already sent my naturalization certificate though, I will send it again with DS-230 and also include another sets of photograph (just in case if they missed the one I sent already).

Hello Friends,

How's the weekend treating you guys out there?

Congrats to KV for SIF and Mark & Ruth for CC.

I have a problem guys, looking forward to someone who can shed some lights on it:-

I became US citizen after my DS-230 was entered on NVC system. As soon as I had my naturalization certificate on my hand I sent NVC a copy of it with a request to upgrade my case.

Today I received an email response of my request from NVC which looks like they are requesting another DS-230 (amended one) and some other documents from me.

I am so freaking frustrated at this point, because I had an artificial RFE (for no reason) for my missing photographs and now I am waiting for NVC to attach my photographs to my case file. If they request another DS-230 or some other documents from me at this point, that's gonna add another delay to my case completion. This is absolutely not acceptable. If they needed new DS-230 from me or some other documents, why didn't they inform me when I called them before sending my naturalization certificate. I asked the operator that "I have recently become US citizen, now what should I do to upgrade my petition?" then the operator told me just send a copy of your naturalization certificate and that's it. They could have told me that they are going to need another DS-230 form and other document if they really needed it at that time.

Guys, please shed some lights here and if you come across to somebody who has upgraded their case while in NVC or find related thread somewhere in VJ please pass me a link.

This is the email reply from NVC

Dear Sir/Madam:

Your inquiry has been received at the National Visa Center (NVC).

The NVC has received notification indicating that the petitioner is a citizen of the United States. The beneficiary's preference category has been changed.

A letter was mailed to the Agent of Choice or Attorney of Record requesting the amendment of previously submitted applicant forms and/or required applicant documents that have not been submitted. The documents listed on the letter and/or the amended forms must be submitted to the NVC in order to complete the processing of this petition.

If the beneficiary needs a form, please visit www.ImmigrantVisas.State.Gov, Applicant Document Processing to download a copy of the DS-230 and/or the instructions. If you do not have access to the internet, you may wish to visit your local library or an internet café.

If a period of one year passes from the last date of contact with the NVC (by email, telephone or mail), all submitted fees and documents will expire. In that case, your fees will need to be repaid and documents will need to be resubmitted in order to continue the immigration process.

First of all they don't ask amended DS-230 as per their email. Downloading DS-230 is their standard wordings in the email template. Read carefully.

What they are looking may be amended I-864. This form only needs the update based on the status change of the petitioner.

Now you have 2 options:

Option# 1: If you wish to complete the review of your case with NVC, you need to mail the amended I-864 to them. Also, check with them clearly about the amended form - I-864 / DS-230.

Option# 2: If you say you're fed up with NVC processing and will submit this amended form to the Consulate at interview time, NVC might accept. But it is up to you.

My question is merely out of curiosity not any other purpose.

But, if a petitioner is already almost done with the NVC process, what is the advantage of informing them that you're now a USC? Maybe I am wrong, but I thought that the advantage of being a USC over an LPR was prior to this stage. Was there an advantage to telling them?

That being said, one can only deal with the situation now and that is exactly what Indigo said, send another DS-230. But I would call the NVC again and ask if there are any other options at this point. Because that would entail having your wife ship out another signed form and that's a definite time killer.

2 things.

1) I-864 petitioner immigration status

2) For LPR petitioner the visa# must be available to schedule the interview. Until visa# available, NVC will hold the petition at NH forever. For USC petitioner, visa# is immediately availale as it is numerically unlimited. But, in Malvika's case, priority date is current now. So, his wife can get the visa# now.

You are right Loto, the email doesn't state clearly what exactly are they looking for. But Miami_Boy told me earlier that his friend went with the similar situation six months ago and NVC asked him to submit amended DS-230. That's why I am assuming NVC is asking new DS-230 from me too. Otherwise I wonder if there's no any change in none of the answer in DS-230 regardless of myself being US citizen why would they need new DS-230? Only the I-864 form has the question where it asks if the petitioner is LPR or US citizen. If that's the case, if NVC only need my new I-864 can I just send that particular page by email where there is question if the petitioner is LPR or US citizen?

Loto, do you think if that's possible.

In the mean time, what are the consequences If I request NVC to proceed with my case and amended forms (whatever they ask) will be submitted at the time of interview by my wife?

Do you think they will send my case to USEM nepal without final review? BTW they have already accepted my AOS package and IV package has already been reviewed without photographs as well.

Thanks Loto, I am gonna have to talk to NVC Monday morning.

In the mean time, what are the consequences If I request NVC to proceed with my case and amended forms (whatever they ask) will be submitted at the time of interview by my wife?

Do you think they will send my case to USEM nepal without final review? BTW they have already accepted my AOS package and IV package has already been reviewed without photographs as well.

Absolutely, there is NO issue.

If NVC forwards your case to the Consulate, prepare a latest DS-230 and I-864 and ask your wife to submit to the CO at the interview. Also, a clear copy of your Naturalization certificate and/or U.S Passport must be provided.

Addition to my above post to Malvika.

The reason for I-864 amendment is - Your legal contract binding of the Affidavit of Support with the U.S government starts the moment your wife becomes immigrant. During the interview time, CO wants to make sure all the forms are up to date, especially this I-864 stuff. Now you have status change, so updated I-864 is required at interview time. This can be achieved routing through NVC or directly to the CO.
