heres a list of what ive done so far (aside from crying and the likes):

1. called the consulate in Paris to ask if they have reviewed my case, and if so, if the packet has been sent. that is where they informed me that the case as been sent back to the NVC on Dec 1st as per their request, and they have no further info

2. from there i called the NVC and explained what the embassy had just told me. they told me that they have no yet received the case, and that it was the USCIS who requested the case, the NVC serving as a middle man. I asked to be transferred to a supervisor (they didnt want to at first but i insisted) the supervisor repeated what the first parrot said and was of no further assistance.

3. i contacted the uscis. spoke to tier one and then was escalated to tier 2. both repeated that because my husband is overseas they dont see why they would request the case, and that would be the DOS (@discotrash, DOS = dept. of state)

4. i contacted the DOS and they confirmed that the case has been sent to the NVC but they had no more info

5. contacted the NVC AGAIN. got a nice guy this time who said it is possible that immigration or someone else requests the case and the NVC just serves as the messenger and wouldnt have any info as to why. they havent received the case yet and have no record of the request.

WHAT DO I DO NOW? NO ONE KNOWS WHERE IT IS, WHERE ITS GOING, WHY, FOR HOW LONG, ANYTHING?!!?!

Any update on your RFE yet? Did they receive it by now? I called AVR last night but the msg. didn't change yet :(

Do you really think that it's gonna take whole 13-14 days for them to enter our RFE in the system? So sad. They should have treated RFE maile in a different manner than other regular mail. What's more in my case, actually it's them who lost my photographs, so they should be handling this thing specially :(

Nope... i mean, they received it on the 29th, but still not in the system. i checked the AVR last night too, and still the same message.

And yeah, i feel like it s gonna take 15 days or so to scan it :( I mean, how long should it be to scan some pictures, or a birth certificate? like 5 minutes....And yeah, that is so not fair to you since THEY lost your pictures...Oh well, what can we do, nothing but wait i guess .....:(

Thanks Mark & Ruth,

By asking to put your timeline for RFE, I was trying to figure out how many days exactly NVC took to enter your RFE into their system. But may be you wouldn't know that. I understand your package was mailed of on 11/09 and NVC received them on 11/12 and you got SIF on 12/02. But trying to know when did they enter RFE into their system. Anyway, Thanks a bunch :D

no Idea as the AVR is still saying that documents are missing like it has been for over a month. :bonk:

An update on my case: Yesterday I requested an expedited interview date from NVC. I got a response telling me they are considering it. But so far nothing. My AVRS says, since 11/29/2010, "You case was completed on 11/29/2010. Allow 8 weeks from this day for further instruction."

@Houston, looks like your case is on top of the Atlantic ocean en route to NH. Until NVC gets it, not much else to do. What you want to do is be a pest and call NVC ever so often. You want to catch them with the case. But before they can send it anywhere else. Tell them to process the file right there and send it to embassy. No need to send it to USCIS any longer. That part of the process has been completed.

I dont think your prediction will be right at this point. I believe, today or monday they will open up your mail. It could be next friday(high chance) for SIF to CC. I am doubt you might get interview in january last week or latest will bethe first week of Feb'11 . You may request for January interview due to NVC lost your photographs.:thumbs:

But you know what M_B, it's taking 14 days in average (from the date they were received in mail room) for NVC to scan our documents into their system. I have found that out from NVC tracker statistics and have also put the Time frame there :D

So I wish they open our mail today or monday but I doubt if it's gonna happen until it's 14 days :(

Since an interview can be schedule any day during the month by NVC I am hopeful even if my case completes by 12/26, I might get interview sometimes in January. Lets see, time will tell everything.

Thanks IS, I know its lucky enough that im here in france with my husband and i should be complaining. but we're both anxious to get home. everything is set and ready for us. EXCEPT THE VISA. his contract at work ends on dec 31st and he'll be unemployed until he comes to the US. which means we'll have to live with friends or family until we come home because we cant stay in an apart jobless. i have to return to the US by Jan 10th to start classes. and he's scheduled to start on the same day. i cant just leave him here with nothing while he waits god-knows-how-long to get his visa.

I dont know what to do. I know we've been pretty lucky&blessed so far, and i know it can always be worse, but i dont want it to be (obviously) this is already so much more than we can take. we're doing the best we can and doing everything right, but something still goes wrong anyway. did we miss something?

Should i just keep calling everyone until they give in and tell me something? should i wait until someone contacts me? im so lost..and scared..

im assuming that for now its in a DHL plane somewhere being sent to the nvc. i dont know. why cant they tell me anything?! am i not asking the right question? am i not asking the right person?!...

HoustonApollo, here's what you need to do: First figure out where you case is now. Then where it is going. Then call the place where it's going and ask them why they wanted it. What I think happened here is that your embassy made a mistake. It thought your husband is in America. When he's not. You case was sent to embassy without final review and/or cc over at NVC. Now that you case is going back to USCIS, it wll be shipped back to NVC. Then just let NVC do the final review and send the case to embassy through its normal channel.

It looks like you can't do anything until you case lands where it's going. This weeks is going to be frustrating for you. Try not to worry. It's all just a dent in the road. Plus, you're already with your husband in France. That's a luxury not many of us can afford. So enjoy your time in France and don't worry. It'll all work out in the end.

BTW, was it Sup Sue who replied your expedite email? You sure?

Whenever I wrote an email to NVC with Attn: Sup Sue, I got reply from someone else....usually from "Lowell", not Sup Sue directly.

And when I emailed them yesterday, they even didn't reply blink.gif May be they were overwhelmed by my email since when they lost my photographs :D

Just a heads up im still getting the same AVR message that the DS230 IV Package is missing, spoke to a another really nice agent Ruby (They do exist) :) She told me she cant see my file and to see if the IV is being reviewed, but the AVR message of missing DS230 happens when they scan the the IV in but is not reviewed. She told me give it another week for the review to be done.

Also, can some help me on my signature on VJ, im trying to add recent updates but for some reason is says that i have exceeded the number of line allowed, i dont think i have but i went ahead and removed the USCIS part but still it wont allow the additional info. Any Ideas?

10/26/10: NVC Case# received by calling AVR.

10/27/10: DS-3032 Emailed, no response.

10/28/10: Called NVC gave both Petitioners & Beneficiaries email and contact info

10/28/10: IIN Received, emailed DS-3032 using supervisor Sue, received response that agent can not be added at this time.

11/01/10: Emailed DS-3032 and have no response so far.

11/04/10: AOS Fee Invoiced and Paid. IV Fee Not Invoiced yet.

@Malvi: Kate replied to my email. But Kate is Sue's nickname. :P

Make sure you are keeping your email concise and descriptive. Avoid using too many adjective. Use more nouns and verbs. You wanna make each paragraph short but sweet, demanding but not imposing, etc.

Do you think any other people know about emailing Sup Sue beside us here in VJ?

On my end, I e-mailed sup and recieved reply on wed tht thy will review my expedite request and notify me. No notification yet.

AVR still says checklist letter sent on Nov 30th. I hope thy open mail by 7th and CC by 10th but w/ my its not possible
