Again, I have a question (sorry to be such a bother) I'm so frustrated with all of this -- it's supposed to be so simple and I feel like I'm messing it all up. :/

Anyway, if you look at the post above with kayo_michael, you'll see that my husband had a J1 visa in 2007 and I wrote it on the ds-230 but he no longer has any record of it. So I'm wondering if we should send the statement in now to prevent a probable RFE or if we should wait until its procesed and hope they don't ask for anything.

Suggestions? Please?

All J1 VISA info are stored in SEVIS or Student and Exchange Visitor Information System database. USDHS which USCIS is part of uses SEVIS DB. So if you don't mention it on your form and NVC finds out about it, they might give you an RFE. So you should mention it on your form. Since you are going to be sending in a copy of your beneficiary's passport, it's going to have the J1 VISA seal in it. And it'll have entry and deperture seal also. You could use those as your proof. This is what a J1 VISA looks like in your passport:

Looks like you sent in your package already. You should wait 'till you get a RFE before responding with your J1 info. If you send a letter now, it's going to be a orphan package. God knows how or when they're going to add it with your NVC case. So just wait for RFE. If you do get one. Chances are that you won't get one.

I did already send it out, it was delivered to them this morning. I included the J1 on the form because i didnt want to "withhold" information, but was also weary because I didn't know what the consequences could be for including it. Decided it was better to write it in.

We no longer have any of the information from his visa because he never used to keep any paperwork, and he received a new passport after returning home from his J1 visa because he lost his old one, so his passport no longer has the J1 seal or entry/departure info on it..but if they have a database with all of this information in it, maybe they can just check that instead of RFE-ing us?...

So you think it would be pointless to mail them a statement before they issue an RFE?

Your AOS was delivered on the 8/11. It'll take about 13 days for your AOS to be in the system. So by this Friday your AOS should be in. Your IV was delivered on 15/11. It will take about 14 days. I think your IV should be in by Dec 1st. This will take a bit longer because of Thanksgiving. Let me know how these predictions end up.

Yup. They can search the SEVIS database. And yes, I think it's pointless to send in stuff now before RFE. Because the NVC drones are not going to know what to do with this package. Just wait for RFE if you get one. But I'm pretty sure that you are not going to get an RFE. Because the document doesn't ask you to prove your previous VISA's.

Read below you will know what to prepare before hand for NVC process

Step 0 - Preparing For The NVC Process

Collect all the following general documents beforehand to speed up the NVC process. Note that these are general documents and it may differ case by case and country by country. For accurate details, please visit: Affidavit of Support Processing and Applicant Document Processing, also select the Beneficiary’s Consulate for consulate or region specific document requirements (after you've browsed to the consulate website, look for a link called "visas" --> "immigration visas", etc.).

Required documents from the petitioner for I-864 Affidavit of Support Package

1. Last 3 years IRS Tax Transcripts (otherwise, last 3 years 1040 and W-2/1099)
2. Original Employment Letter
3. Pay stubs (include a few recent ones and a selection from throughout the previous 3 years)
4. All of the above from any joint sponsors

Required documents from the Beneficiary for DS-230 Immigrant Visa (IV) Package

1. Two passport-style photographs (2X2 inches) of the beneficiary. (Write down NVC Case# and beneficiary’s full name and date of birth on the back side of both photographs lightly)
2. Completed and signed form DS-230 Part I by the beneficiary
3. Completed and unsigned form DS-230 Part II by the beneficiary
4. Photocopy of the beneficiary's passport biographic data page
5. Original/certified copy of beneficiary’s birth certificate
6. Original/certified copy of beneficiary’s and petitioner’s marriage certificate
7. Original police certificate(s) of the beneficiary
8. Original/certified copy of military record, if applicable
9. Original/certified copy of divorce decree, death certificate, etc. of previous marriage, if applicable
