Dear Vj,

Anyone can help me enlighten my concern regarding SSN number?

We plan to submit our AOS soon, however I dont have Social Security Number (SSN) yet. Can I still proceed to submit our AOS application without SSN?

Also, we got married now and got our marriage license too, and we plan to get my SSN number next month which is still has enough time before my I-94 expired (however we just want to proceed to submit first our AOS without SSN yet). Can I apply my SSN using my husband family now or should I still follow my family name as written in my i-94? Does my Marriage License can suffice for granting me to use my husband family name for SSN? Can it be possible? any thoughts would be greatly appreciated from my end.

Inky is right, you do not need an SSN to apply for AOS. What you will need is your A#, I-94 number and non-immigrant visa number (which is printed in red on your K1 visa.)

You will have to apply for an SSN after you receive your Employment Authorization Document (EAD).

File your AOS along with applications for EAD and Advanced Parole (AP) at the same time so the fees for EAD and AP will be waived.

Oh about the name thing too, if you are to use your husbands name, fill out all AOS papers using your new last name(his last name) you will get all your documents in your new name.

If your current immigration document shows the married name, use that. (EAD)

They will ask to see the marriage license most likely - so take that in case.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Oh, thanks for bringing AP application issue, I believed that I can apply this simultaneously with EAD & AOS and the fee will be waived..however, as of now I dont have plan yet leaving US, so I dont really need it at this time...but since its waived I might also submit my AP..My question is, Do i need to provide any reason why I want to leave on my application? As of now, I dont have reason yet...any thoughts?

You can apply for you SSN in your married name even if your I94 is not in your married name. My wife just did it yesterday.

The application asks for the dates of planned travel (part 3) which I left blank, and then there is another section (Part 7) that asks how you qualify for AP and details of your trip. I just attached a letter stating that I qualify as part of applying for AOS, the details of my POE, Marriage, and date I applied for AOS. I then stated that currently I do not have any plans to travel outside the US, but would like to have the document in case of an emergency that requires me to return to my home country before my GC is issued.

Just a little note, first don't ever leave sections of a form blank - you raise your chances of getting an IO who thinks you just forgot to fill something in. Write "unknown" for date and length of travel. At part 7 you do NOT include a letter stating why you are eligible for AP. The instructions state that as an AOS applicant you would send the NOA1 but as you're filing at the same time, you don't need to (like with EAD). No reason is needed, you are applying for AOS, that's your reason (that sometimes it takes a while).
