Hello people.

Now I have to fill the I-864, for my family's process, and I have some questions.

1 - The I-864 can be filled, scanned and send by email as PDF (with the documents attached)?

2 - I will apply for my wife, my son and my daughter. My children are currently dependents of my wife's process. So, I have to write their names in field 9 correct?

3 - On Part 5, I will be sponsor for my wife, son and daughter. The household size is 4?

4 - Now starts the problems :D . I little bit of history...My sister had applied for me when I was 16 years old. At that time I was single, even imagine have kids. And after 12 years waiting, I have married, got a son, and then in 2008 NVC completed my case. At that time, my sister were afraid to include my wife and son and we finished the process just for me. I went to US in June/2009 to September/2009 and then returned to Brazil to join my wife and my son until finish their process (I returned in may/2010 for some days, but returned to Brazil again). So now, I am working in a multinational company but in Brazil. What do I inform here? Self Employed? Do I have to convert my income to US$ and fill? They ask about Federal Tax Information, Stubs income for the previous 6 months, etc. What should I do???

5 - On field 25, Federal Income tax return information, what do I inform? I even don't know what is this....Do I have to make one before send to NVC?

6 - When I received the letter saying that my process would finish, I sold my house and kept the money at the bank, in Brazil. On part 7 (Use of Assets to supplement income), can I inform this money?Do I have to send the Sales Contract too? When informing this money, where do I fill? 26a? 26b? or 26c???

7 - I am not currently working in US, but have some savings (money of house sold) in my account in Brazil. Can NVC deny the AOS because I am not working?

I'm not following the timeline - did you work in Brazil when you had your greencard? About not telling them about your life changes - this could be an issue if you were ever asked if your personal situation was changed, (like getting married, kids) - that would be misrepresentation- About the work in Brazil - unless your work in Brazil will carry on when you live in the US, you will not be able to use it as a source of income for the affidavit.

You know - your suppose to actually live in the US with the greencard, not use it like a visa (which it appears you are doing right now) - what is your ultimate plan?

They want to see your Federal Income Tax return (1040).

Did you work in Brazil while you had a greencard? (greencard holder is a "tax resident" and must report worldwide income to the IRS via the 1040 Federal Tax Form) (but you seem to be using assets - so unless you worked while having a greencard, you do not need to show this.)

Yes - if your assets are not sufficient to cover the 864. For spouse/children, you would need 3X the assets to cover the difference - which I put at $82686.00.

If you they are not enough, you would need a co-sponsor to help you.

I thought send the I-864 to NVC by email, but as they need the original signatures, maybe they will not receive.

I'm not following the timeline - did you work in Brazil when you had your greencard? That's right...When I got my green card, I did not work in US. I went in 2009 and just stayed 3 months in US and then returned to Brazil. Here, I have returned to my life, because I had some bills to pay, and just use the green card lika a visa. Now, that my family's process is almost done, we can go and start our lives in US. The ultimate plan is go definitely to US as soon as they got their immigration process finished. I hope soon...

I understand that I suppose to live in US, but live there without the children hurts a lot...

1. If they allow you to send it via digital - then you can.

4. Ok.

5. You would fill out an IRS tax form for 2010 (in 2011) - so you have nothing to show for the federal tax forms. (since you worked overseas while you had a greencard, you are still suppose to report the income to the US)

6. That amount covers what you would need, and then some. It's up to the consulate if they accept it.

However, you have another issue, if you do not have a domicile in the US - do you? (are you in the US now?)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I will try...Lets see what happens...

However, you have another issue, if you do not have a domicile in the US - do you? (are you in the US now?)

I have my sister's domicile (I have her address). I am not living with her now because I am currently in Brazil, but when finish my family's process, I will live in another place near job (rent a house for example).

I returned because my family were alone and my children were sic, as I was very far...

After send the AOS to NVC, how do I know if the AOS was accepted/approved? If they send the interview letter means that were accepted/approved?

As far as I know, the only thing you can send electronically via e-mail is the DS-3032. You did that and you got them to accept your selection. Everything else has to be in original paper format, scans and pdfs won't do (I think there are a couple of embassies where there is a pilot e-way of doing things, I think one of them is in China).

As far as evidence of income goes, the standard is a signed copy of last year's Federal US tax returns. Everything else is additional and optional. You can use your assets as income; however usually this is to supplement your regular income. I can't answer your question in detail but suffice to say that you need to prove that you can comfortably look after who ever you are sponsoring...there is also something like domicile, where you prove that you live in the US.

You are right...Only some embassies are working with digital forms...Unfortunately, my country is not in the pilot :angry:

The problem is that I don't have evidence of income in US. I did not make the Federal US Tax Returns and the only money I have is the money of my house sold.

As I am "living" with my sister (in her home), could she be a co-sponsor for my family? I think we will stay some weeks, until find a place to rent...

Any ideas are really welcome.

Your sister can be - if her income is sufficient for the number of people she is responsible for. (any dependents, plus the three of your family)

I made a mistake above - I took the (asset count) as if you were a USC - since you are not - you need to provide 5X the amount needed. (So you would need $137810 in cash (assets) (family of 4 @ 125% poverty level 2010 is $27,562. 5X that is $137810.00, your short $27810.00)

What Cash Value of Assets is Needed? The total net value of assets, less liens and liabilities against them, must equal five times the difference between the sponsor's income and 125% of the poverty level for the household size

Sponsors of spouses and children of U.S. citizens must only prove assets valued at three times the difference between the poverty guideline and actual household income.

Sponsors of orphans who will acquire citizenship after admission to the United States must only prove assets equal to the difference between the poverty guideline and actual household income.

What can be used as assets?

Assets easily convertible to cash can be savings, stocks, bonds and property.

Can the immigrant visa applicant count assets that he or she owns that are outside the United States, such as real estate or personal property?

Yes, under the following conditions:

  • The assets must be convertible to cash within 12 months
  • The applicant must show that the assets can be removed from the country where they are located. Many countries have limits on cash or liquid assets that can removed from the country
  • The net value of assets is at least five times the difference between the sponsor's income and 125 percent of the poverty guideline for the household size.

So your best bet is to have your sister co-sponsor if she meets the criteria. She can sponsor all of your family or just some (split them up, so to speak).

She would file a 864A. You would file the 864 (making note of your cash assets)

BTW - the co-sponsor does not have to be living with you, they just need to be an USC/LPR, US domicile, 18+, and make sufficient income to meet the level needed.

We have a joint sponsor which has 7 in Household including me ... His total income in 2009 is insufficient to complete what is required. I want to know if my husband's income would be counted to reach the requirement?

Hello guys...

Unfortunately, I am not happy....

My sister can not be my co-sponsor (or she does not want). And now, the problem is all mine...

I want to know my situation and how NVC procceds...I have my assets, about the selling of my house that is +- US$ 116,000.00; I am a businnes owner that I have my companies in Brazil. I have contracts about the projects I am working and can send to proove...As I work as "Home Office", I can still working with these projects and earning money that could be sent to US, until find a job there.

I am really desappointed to know that I can not count with my sister, but she has her problems and problably.

I am really don't know what to do know....Any ideas? Thank you all

11/18/2010 - DS-230 IV package delivery

12/15/2010 - NVC completion

02/05/2012 - Add new daughter to the process

03/02/2012 - Receive Immigrant Visa Application Processing Fee Bill Invoice ($404.00)

03/09/2012 - Bill Paid

03/12/2012 - Checklist received asking to send another I-864 with the new dependent info

06/28/2012 - New I-864 sent

07/09/2012 - Case completed (Again :) )
