Yeah OBX....that link you gave me , her story was crazy. But i kind of think they are looking at a 17 yr old and think she is more likely to smoke again because she is young and undecided in life. Versus a 31 yr old who is a law abiding citizen. I'll hope for the best.

I know a college professor here who immigrated from Canada and he had a prior drug bust for pot. There were some hassles he had to go through but he was approved. The obvious differences were that he was coming here with his family and not coming here to marry an American (which I would think would give you some leeway) and that he has a phd (which may have qualified him for a special ability waiver). In any event based on this, it isn't in and of itsself a show stopper, especially 12 + years ago. But as others have pointed out, be absoulutely truthful when answering the questions. I would add, don't volunteer any information. If the question is in the last 6 months then answer based on that, but don't give any additional information unless asked.

The denial, if it happens, is because one got caught smoking pot. Uncle Sam is extremely paranoid about drugs and prostitution. You can be from the Netherlands where smoking pot is perfectly legal, or from Germany, where going to a hooker is perfectly legal, and still Uncle Sam will have problems with that.

I keep looking at the DS-230 question and the "have you every been arrested please explain queston " is listed under the "except as otherwise provided by law, aliens within the following classifications are ineligible to receicve a visa. Do any of the following classes apply to you?

So when we put yes to the arrested... the NVC people are prob just gonna flat out deny it huh? But I think I read about people answering yes and still getting through. Gosh they are so intimidating.

They should rephrase that question to in the last 10yrs or something. BLAH

Nobody gets denied for having been arrested. People are getting denied for having been convicted of hard core crimes or crimes of moral turpitude.

Thus, murder, rape, drug smuggling or having been worked as a pimp are deal breakers. Having been convicted of a petty crime (stolen woman's panties from a department store) isn't.

There is no rehabilitation of offenders act in US law.

There is a de minimis amount for pot, can not remember how much.

I would add drug dealing as a major non no.

If you have a drugs conviction than provide evidence of rehabilitation, courses attended etc, not just anything court ordered.

You reccommend we should add rehabilitation? But his inccident was 12yrs ago they gave him a conditional be good for a yr, he was and they dropped it. He never took any classes, or rehab or anything he was 19yrs old! blah And we also ordered court records that show everything was dropped and one conditional. so we don't know what else to do.

Honestly, yes. Entering rehab now indicated one of 2 things to me. 1) that he is just doing it for immigration or 2) that he DOES have a problem and needs to enter rehab.

What I think was meant by the rehab comment was what has been done in the past 12 years to indicate rehab, not what should happen moving forward.

I'd just answer all the questions honestly and not try to over-compensate right now

The cases I remember are more recent where rehab is being undertaken or is required, and those from further back where rehab is completed.

I see no point doing it now but it might be a good idea to have something to show the error of ways has been recognised and resolved. Stupid thing I did as a kid and have now matured etc etc.
