It's been a while, so I thought I'd let you know that my friend's green card was approved. She did get that work stamp at JFK and was hired legally by a reputable and knowledgable company; they got married; she got her Social Security card; filed for and received her EAD; filed for adjustment of status; had their appointment for green card and was approved. It all went quite easily - just 5 months from arriving in the US on the fiance visa to green card approval - and there was absolutely no problem at all regarding working on the JFK stamp, as their lawyer advised, and as opposed to the sense of things stated here on this board. They did not do this under the table - it was all documented. So while I am not giving anyone any advice, and think one should find a respected attorney, the fact is that her process went well and she worked legally from right after she arrived here. The fees are exorbitant, punitive even - I don't know what people without jobs do - but it all went quite well. So now they are settled, and only have to get the green card restriction lifted in 2 years. One more form, one more fee, one more interview - and they are done. Glad that your friend's status was never checked and it's behind them now. The fact that an attorney told them it was unlikely to be a problem doesn't mean that the employer complied with the law.

A K1 visa does not meet the guidelines set forth on page 5 of the I=9 Form.

No, I believe in asking questions of experienced professionals rather than relying on the well-intentioned interpretations of arcane laws by laymen. But I am not here to argue - I truly wish the best for everyone here and their loved ones. Obtaining a green card can be a daunting process, and many of the folks reading here no doubt have limited resources and are worried and intimidated. I think that denying the truth of other people's experiences can be as damaging as giving out incorrect information. All I can do is share the story of my friends, which I have related exactly as it happened, and strongly urge people to seek reliable professional counsel. It is well worth the money you will spend, if you find the right lawyer. By the way, I don't remember if I mentioned that my friends' attorney went with them to the AOS interview in NY and was allowed to be in the interview with them, which they found helpful as she was able to point the examiner to various documents, answer a few questions here and there, and overall demonstrate that they had been working together for almost a year from when they filed the fiance petition, reinforcing that this is a legitimate marriage. I of course don't know if the attorney's presence made a difference in the outcome, but it certainly was reassuring to my friends and they felt that the examiner treated them with an extra level of respect which could be attributed to their having professional representation. So if readers have a good immigration lawyer - which I urge you to have - you might think about asking if they can accompany you to your interview. And you could look into the American Immigration Lawyers Association - www.aila.org - as a resource. Good luck.
