RFE Federal Income Tax Return pls help

Hi guys,

I was hoping that our AOS will go without RFEs but we got one couple days ago. It stays that we should submit a complete Federal Income Tax return sumbittted to the Internal Revenue Service (IRS) from the petitioner on Form I-864, for te most recent tax year. I just discovered that my husband attached only W2 form with I-864. So now I want to send the necessary information ASAP so USCIS continues to review our case.

My husband's taxes were filed electronically and he has printed tax returns which I made copies of. I just want to make sure that this is the complete list of forms we need to file now.

His file includes

1. W2 Employee wage and tax statement for 2009

2. California Resident Income tax return 2009 ( form 540)

3. Form 1040 US Individual Income tax Return 2009

Looking at similiar threads in visajourney and at I-864 instruction I see that there is also Form 1099 which needs to be submitted. Is it a requirement for everyone? I didnt find such in my husband's tax files.

You will need to include any 1099's if he received any...and don't forget to include any attachments to his 1040.

have husband call IRS and get the tax transcripts sent to you - could be faxed if you have a fax machine right next to you.

Moving to AOS forum - this has nothing to do with K-1 visa process anymore.

Bimik: a 1099 is a tax form needed when you have your "own company", meaning that if he was paid "outside of the normal payroll system", he will have to report that income based on a "1099" form... so, if he works for a Company and does not do other type of work, don't worry about it, he wont have a 1099.

What you are including is fine if he does not have a 1099. State taxes are not necessary to include but it wont hurt anybody if you do...

Here is a link to the IRS site to get the "Tax transcripts", I recommend you to ask NOW for the last 3 years just in case of getting another RFE about it (it takes about 10 to 15 days to get the tax transcripts (they are free)(tax trasncripts will give them everthing they need to shut up about it) you can also call the 800 number to ask for them.
