major problem on k1 application please help

hello guys..

i and my fiancee have decided that shell be staying here for three months. from february of 2011, until may 2011. to spend time with me and for our engagement party. but she will resig to her work because her work will only allow her to go on vacation for 2 weeks. as soon as she gets back there, she will apply a new job. and as soonas she gets there too. she will file for my k1. my question is. will that affect my application since shes out of the country for 3 long months to be with me? and have no work for 3 months while shes here in philippines? please help me..

answers are greatly appreciated.. please..

No need as you go to PI immigration and get a extension after you are there.

Not good if she gives up her job as she has to qualify to support you.

NO guares these days on getting another job.

philippines is an open country.meaning you can stay here in the philippines for as long as 3 months to 6 months wihtout a visa...

Not good if she gives up her job as she has to qualify to support you.

NO guares these days on getting another job.

On the contrary, US visitors can stay in the Philippines up to 21 days without a visa. Before the 21 days are up, she has to get an extension through a travel agency or directly through Bureau of Immigration. Since she is planning to stay 3 months, she has to apply for extension twice.

Your future K1 visa application is best served if she is currently employed...because one of the requirements is for her to show she can meet 125% of the poverty limit for a family of two (you and her): $18,212.

Better if you guys plan a shorter trip for her.

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!

If she has no job at the time of the K-1 petition filing, then she will need a cosponsor but cosponsors are not allowed or are rarely accepted at the Manile Embassy (I believe, check the regional forums for better info).

So she may have to find a new job and wait a bit so she can show current income. Short of that, if she has enough assets, she may be able to use those to prove financial worth to be able to support you. I may be best for her to not quite her job and only stay the two weeks that she is allowed. You guys can have an engagement part later after you get the visa and before you leave for the US>

Sorry I read it wrong way around,seems always that the Male is the USC.

Manilla does not seem to like co sponsors.

I have seen plenty of threads for K1 Manilla where they have not accepted a co sponsor.

I seem to remember there was one just a few days ago.

Is your fiancée a dual citizen? If so, she won't need a visa extension. I believe that she will be able to visit you for up to a year.

ya, having a job is a problem, but

not during the initial filing of the I-129F petition.

I say, go ahead and file, job or no job,

but have the job prior to interview day

and

remember - the I-134 is filed and evaluated ON interview day - so yer USCitizen fiancee has anywhere from 6 to 9 months after she returns to USA, to actually land that job and get some serious coin. It's useful to study the timeticks on a K-1 timeline for Manila, get some deep understanding of what happens/when.

For amounts - study the I-864-P document - as the VOs in Manila use that same document for evaluating income .

Sometimes, a co-sponser is allowed, no clue about the reasoning for allowing (but read the reviews here)

Instead of thinking of 'vacation time' away from job -

instead, ask yer lass to investigate

unpaid sabattical or

unpaid leave of abscence

from her job, through the HR department or the Big Boss.

IMO, having a job on returning cuts out a lot of silliness,

and an 'unpaid leave of abscence' is not so difficult to secure back at the company. Do bear in mind, though, that any unpaid leave of absence MUST BE NEGOTIATED prior to leaving.

shes not a dual citizen.she gave up her filipino citizenship..

OK...then she will need a couple of extensions.
