Late Arrival on K-1 Visa

Timeline

Hi Guy's,

I got my K1- Visa approval from the London Embassy in July. I was suppost to be flying on August 17th and getting married on the 26th.

Unfortunately ihad to have a knee operation which subsequently went wrong, so i have to go back in hospital again. Consequently i now wont be flying over to the state's untill end of Oct. This wont cause any problems or mean me being over the dateline's for the I-94 or AOS or ultimately cause me any problems further down the line will it.

K1 visa is valid for 6 months, so provided you enter the US and use the visa within 6 months of issue there won't be any problem at all. Your i-94 will give you 90 days from the date of entry to get married.

As long as you enter the U.S. while your visa is still valid (you should have up to 6 months to use it), then there shouldn't be a problem. In case you get questioned at POE (unlikely, but it could happen), I'd suggest you have a copy of your medical summary with you in your carry on to present to the POE officer.

02-23-2018: Sent N-400 Application online

02-23-2018: Date on NOA, retrieved from online account

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!

No. As long as your visa is valid until your scheduled flight (if received in July '10, it should really be valid until Dec '10), you will be just fine. A lot of people use their visa much after they've received it - besides, if worse came to worst, you could always extend the visa.

As for the AOS/I-94 - As long as you get married within 90 days of your arrival to the U.S. there's no need to worry. Customs will stamp your passport with the exact date of expiration of your I-94. They told me about three time 'Don't forget - you have 90 days!' :lol:
