Your friend would be under the F2A category (lawful permanent resident sponsoring unmarried child age 21 or over).

According to USCIS, the average waiting time for the I-130 to be approved is 5 months. It could take longer, so the mother has to be prepared for that. You'd have to find out how much time it takes the Embassy to process the visa on their part.

My friend's mother filed I-130 in June 2008, in this category ( Permanent resident filling for an unmarried son or daughter over 21) just wanted to know, in which visa category he falls and how long USCIS will take to process his petitions.

IF Your friend's case is still with the UCSIS then they should have already approved this case.. They are currently working with people filed this current year. If your case was approved and are waiting the next step then .. call the NVC.

The Category is F-2(A)...THEY SHOULD HAVE HEARD FROM THE NVC about June 2010 because that was when the case became current and with priority date. have them Go ahead and contact the NVC at 1 603 - 334 0 0700 and inquire about this..

If the Child is Over 21 then it is the F2B Category.

B. Unmarried Sons and Daughters (21 years of age or older): 23% of the overall second preference limitation

They are processing cases for a visa for cases filed in April of 2005 so it will be a few more years for sure. USCIS may approve the petition but the visa will not be available for at least 3-5 years.

Why is it that the only one who can stop the crying is the one who started it in the first place?

Sorry My post above was inaccurate. I told the OP F2A however this was not right. The correct category is F2B and there is some wait on that ..

Disregard my previous post above.

If the Child is Over 21 then it is the F2B Category.

They are processing cases for a visa for cases filed in April of 2005 so it will be a few more years for sure. USCIS may approve the petition but the visa will not be available for at least 3-5 years.

yes I miss read the over 21 part for under 21.. sorry..

My wife has been in the US for 6 months with a CR1 visa. We want her unmarried 24 year son to also become a permanent resident. I see we need to file a just a I-130, birth certificate copy and the fee. I read "when a visa becomes available" and we are wondering about how long that would be. When do we file more forms and documents. Paul and Lili
