Get Divorced to Remarry in NY State due to ON certificate wait time

You also have to figure though with a lawyer I think immigration is like the last thing they are doing.

If they get called to court on a date they were supposed to file for you things get held up, etc.

Lawyers just don't sound like a good time to me.

It's not a form, it's the second stage when you send them all the original documents like:

- police clearance

- tax forms

- document of support

Read the wikis they tell you when

The i-130 is the first form, to start the process.

Then there is a package, some stuff.

Then you wait on your notice of action 1 and 2

THEN you move on to second stage, which is NVC and you can 'opt-in' for electronic and gogogo. =)

Thanks I understand now. So the day I receive NOA2, I switch to electronic?

I wouldn't use a lawyer without seeing reviews of him or her online. I would assume the lawyer would have a minion do any in-person filing or mailing.

I paid someone $250 to review my I-130 package but he didn't catch the marriage certificate thing, he thought the Record of Marriage would be adequate.

I think it's once you get your NVC case number you can send off the opt-in email, then once you get confirmation then you proceed.

The wiki has the steps 100% outlined.

Just read it over carefully, tripple check everything, follow it to the "T" and you are golden =)

See my signature in the green where it says emails given to NVC operator, I think that was where we started the electronic, and with some delays on our end we got NVC stage done in 34 days.

If you haven't investigated the police certificates yet, you might want to do that. Depending on where your spouse needs to get them from they might take a while. Find out, so you can make sure that you will have them already when you need to send off the DS-230, but they won't be out of date.

I agree, by the time you'd even GET a divorce decree, you would have gotten your marriage cert a loooooong time ago.

Here in Colorado it's a 3 month waiting period after you file for divorce and then it's legal assuming there are no court cases. If you have a kid, then it's mandatory to attend classes. My friend said in Tennessee it's a 9 month waiting period after filing. So not sure what it's like in Canada, but I'd assume you'd have to wait a couple of months just to legalize the divorce...

Thanks for the help. It does look like it's not possible to get a divorce quickly. An anullment would require a reason the court would find valid, and we could lie and say we hate each other but the reason would be on the divorce decree which would probably have to get submitted with the RFE and they probably don't appreciate lying in court. Our next two best options would have been to either get a divorce in whichever state is fastest for divorces (it would be convenient if NY were quick) but we might not be able to do it without the certificate - or to just get married in NY and not tell them we're already married in ON.

For the life of me I CANNOT UNDERSTAND why government cannot just exist online and be fully automated for ####### like this. Paperwork processing times should not exist in 2010 at all.

Then again I don't believe in controlling the border either.

Not sure why everyone thinks its only mexicans! People from other countries suffer a lot, seen it first hand, and i shouldn't want to live there! The idea of a free border would be nice, but would not work now a days, too many radicals!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

You think Mexicans will keep immigrating after labor demand is saturated? We've already reached that point and more of them are leaving than coming in.

Mexicans, much more to it that that.

Everything suggests that numbers are still increasing, may be bad in the US but worse elsewhere.

I disagree, I don't think there's anything more to it than that, besides the drug trade which is another thing that cannot be fought effectively at the POE. Keeping out Al Quaeda is a joke, they're not desperate for pool boy jobs and can get proper visas for their people.
