He's lost you anywhere from 2 to 11 weeks -

you won't know for certain until the casefiles arrive at NVC.

Did you hope for any K-4 visas ? for any children?

If so - wei - stop - you must file I-130's on the children - and

you can get some expedite at USCIS for the I-130's on the children -

see http://www.visajourney.com/forums/topic/255138-k3-k4-visa-converted-to-cr-1-by-national-visa-center/page__p__3918125#entry3918125 for a packaging template.

Well that kind of sucks. Do we have any more fees to pay, and can we do anything about this before the applications get to the NVC? No, no children by the way. What is the procedure now once the I130 is approved?

Sorry for the questions, but as with everyone, we miss each other and want this done as quickly as possible.

Hi everyone,

I have a question regarding the K3. My I130 was filed two month before I filed the K3. Would the K3 have any sort of an impact on the I130 like slow it down or anything?

Thanks!

Ya, sorry,

I apologize on behalf of USCIS, even though I don't work for them,

as

any I-129F filed after the I-130

forces

the I-130 to be 'yanked back'

in time

to match up with the I-129F that you just filed.

so

if you flled the I-130 2 months ago

and got an I-797-C on the I-129-F, last week

then

the I-130 was pushed back in time,

to 'marry'

with the I-129-F, from last week.

It sucks, I know, but

who's advice were you following?

Did you see this? ---------> http://www.visajourney.com/news/2010/02/07/department-of-state-to-close-k-3-visas-if-i-129f-and-i-130-petitions-approved-and-received-together/

If you have any lawyer involvement, I strongly suggest to you that you 'ding yer lawyyer' for a refund, as this is a major faux paux (I call them #### ups) - suggest a lawyer rebate of 450.00 USD - as

Filing for a K-3 does 2 major things, now -

-- delays processing on the I-130, anywhere from 2 to 11 weeks and

-- guarantees that the I-129F will be administratively closed when the I-130 and I-129F travel together INTO NVC.

It's OK if you don't believe me - you can wait this additional time, until you have approvals on both casefiles - then - wait 2 to 3 weeks, NVC will contact you about their action for administratively closing the I-129F

If you need 'verbiage' to request a rebate/refund/offset from the lawyer, let me know?

Kind of sucks? what? Look, the CR-1 visa is a superior beastie - if you deign not to believe me - hey ! study this --> http://www.visajourney.com/forums/topic/204324-wondering-if-i-made-a-mistake-marrying-in-us/page__view__findpost__p__3060767 then let me know yer thoughts, yes?

IMO, it sucks loads !!! USCIS still allows the filing of the I-129F,

but

NVC administratively closes the I-129F, when both I-130 and I-129F travel together into NVC -

and

about 99,2 percent (sorry, this is made up percentage, out of my backside)

travel together into NVC.

more fees to pay? absolutely !!!

whilst at NVC -

AOS/I-864 - 88 USD

UV/DS-230 - 404 USD

plus there's more work to do - see

DS-230 - http://travel.state.gov/visa/immigrants/info/info_3190.html

I-864 - http://travel.state.gov/visa/immigrants/info/info_3730.html

General NVC stuff - http://travel.state.gov/visa/immigrants/info/info_1335.html

and if you wish to 'go fast' with the online payment portal -

wei - here's a mini 'how-to' --> http://www.visajourney.com/forums/topic/221785-ds-3032-slowdown/page__view__findpost__p__3560467

Good Luck !!!

and they do !

but

normally, when filed for the same person -

the two casefiles are given to the same adjudicator (who processes them seperately and independently)

and

they are sitting on the same desk.

when both are finished, the adjudicator sends them off, together, to NVC .

How sure are you of this?
