I-864P Poverty Guidelines.

Hello All.

I appied for my husband's adjustment of status I-485 form. I received a request for initial evidence saying I do not meet the 125% of the federal poverty line. I live in California and I make $31,000/year. On the Poverty guidelines form is states for 2 people the minimum should $18, 212 for 2 people household. I am confused as to why i received the notice if I make enough, am I missing something?

Do it look at your income for the last three years making more than $18212?

Any help would be appreciated. this form confuses me.

I sent my Federal Tax returns for 2009, most recent bank statment and proof of stocks. I also listed total income for the last three years (2007 I made on $12,000, but 2008 and 2009 I made over $30,000)

Timeline

I would send recent paystubs and an employer letter to corroborate that your current income meets the guideline. From what you've said you haven't proved what you are making right now.

Did you send in the corresponding W-2/1099 as applicable with that tax return?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

I am self emloyeed, I have my own business. Just doing research it looks like the USCIS counts the "adjusted gross income" after deductions, etc.

So, it states I have to submit bank statments for the last 12 months, any stocks I have, or assests such as real estate, etc AND have a joint sponsor fill out the I_864 and send ALL information back.

Am I then allowed to have my father be a joint sponsor and send his information along with all other information requested?

What is your income on Line 22 of your 1040? That is the income evaluated for self employed persons.

Did your AGI make the cut?

Did you also provide all the forms/schedules with the tax return (self employed fills out a lot)? You have to prove the income, just sending in the tax return with out the forms/evidence sent will not work.

Yes - you could add a joint sponsor - but if your current income is sufficient - then you do not need one.

I would suggest you get your IRS tax transcripts that show everything you need.
