proof of having met in the last two years and proof of on going relationship please help me. im begging you

hi guys,

i have some few questions, I and my fiancee met sometime on march 2009 when she visited her family here in philippines. we do not know each other yet that time. we met a bar, started a conversation.I never asked if she was married that time. it was very rude to ask knowing that we just met.and she dont look old thats why i did not suspect she was married that time. along the way, as we get closer a little and she was a little comfortable to me. she then told me about their marriage. that it was rough and about to end. i was supportive of her and tried to comfort her that time. we had two dinner dates. it was on the second dinner date that she told me about her marriage. she flew back in the states. we exchanged emails, facebook, and number. i did managed to add her on my facebook but i never planned to destroy the marriage. so i manage to make friends of her. just casual chatmates. and swear to god. it was never intimate chat..the chat was in yahoomessenger. we lost contacts for almost a year. i didnt know what happen to her ... sometime in may 2010, one night, i saw her online in facebook. and i said hi, and the conversation goes. she told me, she had divorced wth her husband already... i was sorry for her loss but deep inside me, im glad.im just being honest. for over a year, i thought i really have no chance to have the girl of my dream. we started chatting on facebook, i taught her how to play games in facebook. then weeks after that, she gave mer her new email address, skype, and yahoo. sometime in july 2010 i told her how i feel about her. and im sure of my feelings. it somethign i cant put in words .im sorry guys. i cant find a suitable word to define how i feel for her. its unexplainable. i asked her if she can be my girlfriend. at first she was laughing about it knowing we have a huge age gap. like, im 24, and shes 33. i told her, that to me it doesnt matter. what matter is I love her and i want to be with her for the rest of my life. and things became a little serious. we started exchanging emails, i sent her some e-cards. and i send a snailmail ecard for her to surprise her. we chatted at skype for long hours. like we had this one chat that we spend around 5 hours. just talking. heres the glitch.. minutes ago... I proposed to her on skype... i told her, id be wlling be your husband and will take care of you forever. she cried, she told me the reason why she cried was for once in her lfe, she felt loved so much. so much that i would spend the whole night chatting with her evenif i still have to go to work the morning after. i sometimes have no sleep going to work.lol..

and she said yes to my proposal. she wants to marry me there in the US. and shes coming to visit me this december to spend some time with me and for me to formally ask her hand to her mom since her dad died long time ago... she just told me about the requirements of a fiancee visa. i have no idea what it is all about. i just signed up here. and found out that we need to have proof of a genuine relationship and proof of meeting for the last two years..

the biggest problem is.. Hell that i know that she will be mine at the end, and that k1 visa reuqires pictures of our proof, i would have taken every single minute of our interaction... in short.. i dont have pictures to proved that we have met in ghe past 2 years tho shes going here on december 2010. allthough, her passport was stamped during her visit, but other documents that would proved that we met is zero...as in nothing..

second problem is.. if by any chance, we have a picture of that, will the immigration question that proof of meeting since during that time, she was still married? can she be sued for adultery if we happen to have a picture or proof that we have met that time in a bar? im really confused..

so far, from the time we i learned about the requirements, the only available records as proof are those chats from gmail, since they automatically save it. and skype. the only problem i have in skype is we dont chat often, because we can see each other and talk, so we dont type the words..

another evidences i can show, is that, she asked me to open a bank account so she can send me some money.. she wants to sponsor my examinations for nclex and cgfns. since i am a nurse. and most probably, i can have those a proof. and phone calls as well.. ..

can you suggest me of what other stuff that i can provide to suffice the primary evidence of our relationship?

if they can just open my heart and they can see whos inside it..lol.. i would gladly appreciate your response. thank you

Passport stamps are all that is needed to prove you met in person for the requirements.

Photos, receipts, are secondary evidence - but the stamps are trump cards.

The other requirement to be met is that you are both free to marry at the time of the filing of the petition. (so, in other words, it will not matter if she was married when you met, only that she is divorced and free to marry when you submit the 129 - however, you may have issues at the embassy interview)

About the other evidence you would need to show an actual relationship (at the embassy level) - you can check the guides above.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Welcome to the website! Please look at the Guides and read about the process to clarify all questions you may have about the steps to take. Then, if you still have specific questions ask in the forum. There are many helpful and knowledgeable people on the site.

You cannot do anything now about evidence that you could have had (such as pictures of your first meeting), but you can begin to gather evidence now and continue to gather it until your interview. Make sure to take LOTS of pictures when she visits you in December. She should also keep her boarding passes of her upcoming trip, and submit copies of them as proof of meeting within the last two years. During her visit you should sign your biographic information sheet and give her a letter stating your intent to marry her. She will need these signed pieces from you to submit in the I-129 F packet.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Bobby, i do not agree completely and here is why. That he was in the Philippines does not mean he met his fiancee. I was living in Ukraine for two years and met Alla on a trip to Prague, CZ! I never "met" her all the time living in Ukraine, Go figure...could be because there are 45 million people there and...well, you can figure the rest.

"Secondary evidence" does not mean "unnecessary evidence". Secondary means "in support of primary". I went to the Philippines, here is my passport stamp to prove it, and while I was there I met my fiancee, here is our photo together.

Have there been cases where people got approved without photos? Yes, I think there has been. I think they may also have had more primary proof of meeting than "I met her in a bar and talked for a while", could be just a guess on my part. I can assure you that 14 pages of sappy love story and how you were embarrased to ask if she was married or it would be rude, etc., will have NO affect on anyone at USCIS and will not make up for needed EVIDENCE. Have there been cases where people sent a few photos and passport stamps and were asked for MORE? Yes, absolutely. Simply do a search of the forums here and you will see which there is more of.

The REAL problem is this...IF he sends his petition without photos (or other evidence) taken PRIOR to filing the petition and they request more evidence...he has none and the petition will be denied. It is a $455 chance. You pays your nickle and takes your chances.

I happen to find 3 pictures of us last march 2009. days aftr our first meeting. but it was not dated. i mean there was no date on it.. can i still make that as secondary evidences?. she had some purchases using her credit cards while she was here in philippines. and tho she has lost her boarding passes and her ticket, can she be able to ask the airline to issue a proof of her trAVEL? is that possible?

I wouldn't worry about March 2009. They want proof of meeting face to face within the last 2 years. So focus on her visit in December and save everything. Tickets, passport stamps, take pictures, save credit card receipts etc. All that will show that you met face to face and that is all that is needed for petition. Later, when you get to the embassy stage you will need to show more proof (of ongoing relationship) that you will start collecting after her visit.

Dont worry if they dont have dates, is fine, people change over time, hair grow or cuts, so i think thats fine, for the beggining... the boarding passes are not going to be reissued after this long, i am sorry i happen to work for an airline... if she has the stamp i think thats fine, but like i said give time, let her come for december and after that you apply for the K1...

If you wait until after you see her again, there would be no need to mention the previous meeting...or you could. It does not matter. You need to privide eveidence of metting in person at least ONCE within the two years prior to filing the petition. It doesn't matter WHICH time, first tiem, third time, last time...doesn't matter. It does not even matter HOW you were "introduced" only that you show you have met in person within the last two years. The question does not ask "How did you meet?" The question does not ask "What is your love story" it asks for details about meeting at least one time within two years. That is all.

There is no advantage, for the petition, of meeting one time, two times, 400 times. One is enough. Enough is enough. If you met more times you still have to do the same thing and they will not approve your petition sooner. I had met with my wife many times before we filed for the petition. I sent one photo and described how we initially met (we initially met in person by chance) but it could have been any of the meetings I described. My description was two sentences.

So...do what you will. mention it, don't mention it (do not lie about it) write one sentence or write a book...just send proof you met in person and the Petition hander-outers will be happy.

thank you for your response. are you saying that, even though we have little evidences of our last meeting which was march 2009, as long as we have lots and lots of proof of her visit this coming december 2010, it would be fine? our plan is, after her visit her, hopefully when she gets back there, thats the time she applies for k1 visa... do you think what we plan is correct? sorry if my english is mess up a little bit... i hope u understand. im not a native speaker of the langauge. i apologize..

Well, yes and no. DO NOT lie...ever. If you met on the internet, SAY you met on the internet. But you do not HAVE TO say how "you met" at all. If you met in person 110 times and you tell them about ONE of those meetings it is not a lie.

thank you for your response. are you saying that, even though we have little evidences of our last meeting which was march 2009, as long as we have lots and lots of proof of her visit this coming december 2010, it would be fine? our plan is, after her visit her, hopefully when she gets back there, thats the time she applies for k1 visa... do you think what we plan is correct? sorry if my english is mess up a little bit... i hope u understand. im not a native speaker of the langauge. i apologize..

Yes that would be fine. Waiting until after her visit to file seems like the best plan.

As far as proof of ongoing relationship (you will need it at your interview at the embassy), you can use plane tickets and photos from any visits after you file (if you visit), emails, chat logs, phone records, letters, anything that shows you communicate and proves a relationship.
