Just dropped off two money orders at my lawyers office, one for $380 and the other for $70. He said he recieved a notice stating that this was due, but I still haven't recieved an approval for the I-129. Is this normal? The lawyer also said that my wife's interview would be in the next couple of weeks, but seeing as everything he's told me up to this point has been BS, I find this hard to believe. Any thoughts?

The fee bills you have sent are in connection with an approved I-130 that is now at the NVC.

IV Fee Bill = $380....DS-230 This is the Application for Immigrant Visa and Alien Registration. CR-1 visa.

AOS Fee Bill = $70....I-864 Affidavit Of Support.

I doubt if he is only just now asking for and submitting the Fee Bills that the interview would be in 2 weeks. NVC still has to review the I-864 and DS-230, security checks run and then when all clear and case complete your case will be forwarded to the consulate. Which country is the applicant from? That will usually determine how long the wait is for interview once case is complete at NVC.

First of all, thank you for your response. She is from guatemala and I haven't seen too many cases here on VJ from guatemala. As for the documents you mentioned, my lawyer had me fill those out in the beginning of the case so I would assume those are there and under review now, if he sent them in. I thought they were for the I-129 which just shows you how little communication I have with said lawyer. He has pretty much lied to me from the get-go, so I have no reason to believe him now. I'm glad to know someone is willing to give honest advice without charging a thousand dollars. Thank you. Any idea how long the I-130s are taking at the NVC to process the I-864 and the DS-230 you mentioned?

When you file an I-129F petition which when approved enables your spouse to apply for the K-3 visa, there is the need of an approved I-130 in order to apply for immigrant status once in the US on the K-3. However the filing of the I-130 before filing the I-129F has its own process. When approved it is forwarded to the NVC whereby it continues to be processed in order for your spouse to apply for a CR-1 immigrant visa (the biggie....green card). Your lawyer wont of submitted the I-864 and DS-230 without the payment of the fees. Once NVC has both it generally only takes a couple of weeks to be reviewed and for case to be complete. Security checks can add time to this stage though, but not always. When one is in a situation where the I-129F is approved and at NVC and or now at consulate, and subsequently also has an I-130 approved and at NVC but not yet completed the NVC process which takes a couple of months....one can notify NVC that they will be interviewing for the K-3 and then NVC will return the approved I-130 to USCIS where it waits for the adjustment of status process once the spouse enters on the K-3 and makes an application. In your situation it appears that you are almost through the NVC process for the I-130 and your spouse will be interviewing for the CR-1 immigrant visa. At one stage the processing of an I-130 and up to interview stage would take up to a few years. Nowadays I-130's are approved and processed much much quicker and in many cases beat the K-3 process that came about originally in order to reunite couples sooner in the US to await the approval of the I-130.
