Hi all,

AOS time! Just to be clear I am the US citizen filing for my husband.

I was reading through the instruction on the I 864 and noticed that it says check box A if you filed an I 130. I actually filed an I 129F all those months ago when my now husband was my fiance. What do people who filed an I 129F check? I though the I 130 was what K3 people filed. Maybe I'm getting confused though. All these form numbers sound the same after awhile.

Also, here's my situation in terms on income.

-Since March of 2010 I have been working in the US and earning well over the poverty line. I have a job offer letter and pay stubs.

-In December of 2009-Feb 2010 I was living in the US and unemployed.

-In Oct 2007-Nov 2009 I was employed overseas (UK). I believe my tax returns for 2009 and 2008 were over the poverty guidelines, but not by a great deal. Maybe a few thousand over.

Do I need to send copies of my 2007 and 2008 tax returns? I was living in a different country earning foreign currency, so I feel like it doesn't accurately reflect my earning potential in this country. Also, can I just submit a photo copy of my return or do I need a transcript from the IRS? I also don't have W 2s for 2009, 2008 or 2007, because I was working abroad. Is this an issue? Can I just sent a letter explaining I was working abroad?

checkbox - no, don't check it.

job offer letter only shows that you were offered a job. there's no 'history' with that letter, showing that you accepted it - so I wouldn't use it as any base evidence of 'current 2010 income' at all.

go back to the HR department or the big boss, ask for a 'letter of employment'.

This will state yer annual salary or hourly wage, and position or title.

Pay stubs are important - include photocopies of all.

for 2009 year and prior years - wei - get some tax transcripts !!!

You have some choices, here, when calling in via telephone -

--postal mail back to you- 2 weeks or less

--fax xmit into yer fax machine - same day

--walk into IRS office, get them yerself - 90 minutes or less.

Which box do people who filed an I 129F check? It doesn't appear to be an option on the instruction form. I'm fairly certain I need to file an I 184 for us to adjust status.

AOS time! Just to be clear I am the US citizen filing for my husband. No you're not. HE is filing HIS AOS and you are sponsoring his AOS by completing an I-864. This is important because USCIS won't talk to you about HIS AOS case, they will talk to you about YOUR I-864 though

Can I just sent a letter explaining I was working abroad? Did you file taxes in the US for 07, 08 and 09? If so, you should get copies (IRS transcripts are the best so you're sure you've not forgotten something). If you DIDN'T file taxes and you were supposed to, you will need to file. If you didn't and you didn't have to, you must include information to explain why you didn't have to. Because you will be relying on your current income you will need to include a letter from your employer outlining your earnings, and your payslips.
