Hello all,

hope your visa applications are running smoothly. I am in a slight indifference with my wife about an ADJUSTMENT OF STATUS when you enter America on a IR-1/CR-1 visa, I was under the impression that on this visa conditional residence visa the 1-175 (A.O.S) has to be applied for within 90 days of setting foot, am I correct in my assumption or way of the mark?

CR-1 IR-1 DOES NOT AOS!!!!!!!!!!!

they already did at NVC they get a green card in the mail.

you apply for ROC according to the date on the green card that comes in the mail.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

Okay... another question, why does it state on this website that if you are under 2 years married at the time of entry you will be issed a !-155 stamp and that the green card is only valid for 2 years and due to this ... a removal of status is required via a i-751 (not the I-175 that I typed earlier)

Also, if your relative is your wife or husband and you have been married for less then 2 years at the time of his/her arrival at a port of entry, then he/she will receive a temporary I-551 Stamp and then later a Green Card by mail good for only 2 years. Ninety days before the green card expires you will have to file an I-751 form to remove it's conditional status.

This is taken from the IR-1/CR-1 guidelines

Yes a CR-1 is for 2 year green card you REMOVE CONDITIONS that is not AOS. It is Removal Of Conditions. Please see the guide on removal of conditions. After the 2 year card you get a 10 year green card. Fee is now 505$ for removal of conditions.

IR-1 is for 10 year green card. you dont remove conditions you wait untill you are able to file for citizenship ( if you want to )

CR-1 visa types are issued a 2 year card - if they want to have a 10 year card, later, then a removal of conditions 'packet' is filed 2 years after having the 'first green card'.

IR-1 visa types are issued a 10 year card - not need to 'remove conditions' at all, no 'removal of conditions' packet needs to be filed.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

so - if you come into USA 2 years (plus a day) after yer marriage date, 2009-02-14,

then you'll qualify for IR-1 visa stamp at the POE. You must remind the Immigration Officer at the POE about the 2 year rule, they seem to be a bit dense and doltish.

So please correct me if I'm wrong again, I normally am, this site has a tendency to force humility from me.... when I arrive in the USA the next step in nothing for a full 1 year and 9 months, right up until the removal of status?

yep you dont have to do anything cept for get ur GC in the mail, apply for SSN if you dont get it in the mail and find a job ( if your going to work ).

hey - I am in a slight indifference with my wife - has totally different meaning in USA, than in UK - I had to 'change hats' to understand you (but that's ok - I understand all English, not just Texan)
