Hello VJ

i have question regarding my I 130 . I have sent i 130 for my husband in April. My husband live with my in US. Today i check my status it's says application was sent to NY for interview. Since i'm LPR i sent only i 130. can i send i 485 package for my husband now or do i have to wait until interview is over?

hard to say.

easier to answer - IF you can tell us -

the I-130 was approved, or not.

USUALLY, when an I-130 is sent to a local office, prior to approval -

then the PETITIONER is going to get interviewed at the local office -

is no concept of turn around time for this - anywhere from 2 to 8 months -

as USCIS is really lame for 'going fast' for 'local interviews' .

So -

was the I-130 approved, or not?

alrighty then -

you'll get another letter, with the actual appointment date.

If you want to get pro-active, in about a month from this CURRENT LETTER date,

go into the local office via an infopass appointment, and have a long conversation with a Senior Immigration Officer. The casefile MIGHT be there, by that time.

you can't send the i485 since your only a LPR, he will go through consular process. he'll probably need the waiver depending on how long he has been here.

tell us more about your husband's status, how many times has been in the US and for how long?

being proactive

I've been studying this cr@p for about 14 months now, trying to understand the process. Here's what I've learned about 'local interview of petitioner', so far (this is a 'first run, first edit' so be gentle, ya?) :

So - you've been pegged for an interview prior to I-130 approval.

Sorry, much, as this sucks, loads - and delays any normal timeline for processing.

The casefile has to be transferred from a national service center (there are 2)

into the local USCIS office. That takes some time, is never done within a week.

Then, the local office has to 'get it into their queue'. This takes time, also.

Once it's in their queue, an appointment letter is generated. Apparently this is taking about 1 month to actually generate the letter.

Then it's mailed out to you

Then you receive it - it's got some date in the future , anywhere from 1 to 3 months in the future, where you have to attend the interview.

To 'be proactive' on 'this' -

About 30 days after you receive notice that the casefile is going to be transferred to a local office -

Set up an infopass appointment for this local office via http://infopass.uscis.gov/ - this will be about 10 days to 2 weeks from the date that you schedule it - so total time, from the notice date on casefile transfer, to infopass appointment - is about 6 weeks. 6 weeks is enough time for a local office to receive the casefile and start to prep it for their local queue.

Once yer at the local office, ask the first Immigration Officer to 'pull the casefile' - expect to wait up to 2 hours whilst they locate it. He'll ask you why yer there - you tell them that you have some concerns about yer casefile and you need to talk to the Senior Immigration Officer. Do not tell him anything more than this. Do not mention anything about an interview, or additional processing, at all.

THEN - ask to speak to the 'big boss' or 'Senior Immigration Officer' there.

Show him the letter that stated the casefile was to be transferred, then tell him that you understand that you are to be interviewed,

and ask him if he can interview you TODAY or TOMORROW. If he says YES, great - go forth, be prepared to have some total time at that local office anywhere from 4 to 7 hours. When the interview is finished, ask him to expedite the 'sending off' of the casefile back to the National Service Center (EAC-VSC or WAC-CSC) that's handling the casefile. Ask for his phone number and the phone number of his admin person, and the phone number of the Visa Officer that covers for him when he is not available. Let them know you'll be calling in to check on the status of the interview, and also the status of the 'casefile send-off to National Office'.

IF he says NO - then ask him specifically (do not ask him the texts in parenthesis) -

--WHY AM I TO BE INTERVIEWED, and WHAT THINGS SHOULD I BRING WITH ME for the interview?

(IF he answers you - then you know. You might not get an answer, so ask him to review the casefile briefly, to answer you)

--CAN WE SCHEDULE THIS INTERVIEW NOW, for sometime next week?

(it's possible for them to do this, but you must ask for it)

So really, to 'be pro-active' on this - is a method/way to 'trim time' off the abhorrent 'wait time' for USCIS to sling yer casefile around from national to local office then back to the national office. You're attempting to trim time once the casefile is sent out, and yer attempting to trim time after the interview.

Trimming time is important, ya?

i have my 'standard process' interview on Tuesday. I had gone to the local office and they said they would schedule it within two weeks which they did.

I am a USC petitioner and applying for my spouse. Only reason I an think of is that I was a LPR when I got married, and applied soon after I became a citizen.

I have updated my supporting documents, transfer of funds, new affidavits, recent pictures from recent trips. Recent phone and skype bills/transcripts. That is pretty much all I have.

Wish me luck, I hope they approve it same day and send it to NVC instead of back to CSC to NVC.

can you detail a bit about the 'timeline', from

'notification of local interview'

to the actual interview day?

it may or may not be something like this -

--notification of local interview

--notification of case transfer

--notification of appointment at local USCIS office

--appointment at local USCIS office

then add in the dates on your stuff, adding also any other timeticks.
