Hello,

Sorry if this seems common knowledge but I want to know what the implications are. First, background info, my fiancee is here from the P.I.s on a K1. We will get married on 8/20/06 (which is day 88 after her arrival). It will take a week or two after that to do the paperwork for her AOS. But that means her I-94 will have expired by that time. Will we have problems? Will she be "out of status" and what that mean?

You will be fine... the only thing you have to comply with is that you are married within 90 days of entry.... there is a large number of people who take a few weeks after the I-94 date to file for AOS...

Dont worry enjoy your wedding day and file your AOS as soon as you are ready....

Not that I would advocate following my example, but we filed for AOS about two months after my husband's I-94 expired, and we were approved without any problems.

Why can you not have the paperwork all ready to file the day after you marry? Just as a matter of interest....

Umm....marriage certificate perhaps? I received mine at the time of the wedding because I was married at the courthouse, but I believe for a church wedding there can be a lag of up to a week or so before the marriage certificate is recorded.

Well, I have basically had to do all the wedding arraigments myself. I'm tired. I need a few days to do nothing. Besides it seems we just finished with the K1 paperwork and now this. I have the forms but I haven't had a chance to fill them out or anything. Oh, and we leave for the honeymoon on Thursday.

That's why I was asking! I too married in the courthouse, and had my marriage certificate the same day. But that doesn't meant that the packet can't be complete with the exception of that certificate if you so choose for it to be.

Bobsled, being tired and fed up with the whole bureaucracy sounds like a good enough reason to me.

Your K-1 status is now 'out of status'. Your wife is now 'legal' in the U.S. There is no time frame on when your wife is required to file for AOS. After you wife files for AOS and gets her GC approved she will then be 'officially legal'. Your wife will have the new luxury of paying taxes should she decide to work. An EAD will also grant this on an interim basis. A SSN is also a benefit is she does not already have one from her K-1. I am in your situation right now.

Me and my wife were married on Nov 5, 2005 and did not file AOS until the last day of July this year. After we married I changed jobs and moved out of state, but now I am back. We needed all the money we could get between moving. We had to delay filing her AOS. We only filed for AOS and not EAD or AP. Her interview is set for Oct 3. Her biometrics is already finished. This has been a fast turn around time (perhaps less paperwork speeds the process)? It was my wife's choice not to file for EAD or AP because she is taking classes now and does not plan to visit Ukraine anytime soon. I told her the benefits of both and she still said, "no". She said, "by the time I get my green card I will finish some classes and get my SSN...then I can look at future employment possibilities".

Take a deep breathe. Enjoy your honeymoon and keep reciepts, bills, and take photos of your honeymoon. Make a photo album and take with you to your AOS interview. You both deserve a great time.

The sooner you can get this done the better, but there is no penalty for being late.

I guess you have plenty of responses already, but it never hurts to be assured and reassured about things like this. We, too, filed for AOS about 2 1/2 months after Craig was out of status, and it was never even mentioned---approved without issue. It's always best to do it as soon as possible, but I wouldn't be overly concerned about it either. M.

By the way, congratuations on your wedding, which I just realized is today! (F) M.

We waited over 1 1/2 years to file AOS , as long as your spouse entered legally the overstay will be forgien once AOS is filed.
