K3 Petitioner - Part C of I-129F form

Timeline

I am USC petitioning K3 for my spouse. Part C of I-129F form - item 2, I answered no.

Recently I was arrested for a DUI - no prior record or any legal problems. Not even a speeding ticket. Got probation and the charges were dropped and case dismissed. Records expunged!!!

Did I fill the form correctly (Part C of I-129F form - item 2)???

Will it come up during background check?

Will this affect/ delay my petition for my spouse???

Please help...!

it will come up during background check, it should declare if you got the probation, even the records has expunged,. when you got your noa1, few months later or so they will continue the background check and before you will get noa2 they will asking it, and they will sending you a request of evidenced with one month of prior date to submit. If anyone had legal problems they should attached the complete documents when they start filing because later the uscis will asking the RFE from the petitioners. I think it can caused delayed process , the court paper submitted should be certified from the court with seal.

Sept. 2009 = Hard copy of NOA1

July 29, 2010 = Initial review

I-129F and I-130 are approved =Aug. 30, 2010

NOA2 Hard Copy =Sept. 4, 2010

Got the NVC case assigned number = Sept. 13th, 2010

NVC processed completed = Feb. 14th, 2011

Medical at St. Luke Manila = Feb. 21, 2011

Interview at US Embassy Manila = March 11, 2011

Visa Issued == March 14, 2011

Visa delivered/ Visa on Hand= March 17, 2011

CFO Counseling and Seminar == March 18, 2011 ( just 2 and half hours done at the same day ) and got the passport sticker.

Flight departure from Philippines = March 23, 2011

Arrive in the US = March 23, 2011

3rd yr. Wedding Anniversary = March 24, 2011

SSN card Recieved = April 1, 2011

Begin working = April 2, 2011

Received State Identification resident = April 7, 2011

Green Card 10 years unconditional received = April 15, 2011 @ 4 pm

I-129F and I-130 are both approved today Aug. 30, 2010 ,

Sept. 4, 2010 got a hard copy of NOA2 for both petitions,... waiting for the next step......------ oh yeah!!!----K3 Turn to IR-1 for Spouse petition for more than 2 years of marriage

Hey vaio - welcome to VJ !

IF you are filing a K-3 needing/hoping to get K-4s, also, for any children - EEK - time to file new I-130s on any children - 1 for each child.

K-3 isn't really a useful visa these days, when (as Darnell posted) the I-130 and the I-129F are approved (and yes, they will be approved together as has been the case for years) on the same day and reach NVC, NVC will close the I-129F. It's a waste of paper and resources and has no benefit to you and your wife. You can, of course, petition for the K-3 and think that every case is different and even if there is a small chance of her getting here earlier then you'll risk it, but I just like to be real

October 16, 2015 - US Citizen
