We want to file for Cr1 visa but we are getting confused. My wife lacks 6k from all areas of income child support incuded. She has 2k in savings and 65k in a 401k.

there will be 5 of us me included

do we file cr1 visa and use this as assets for the diff in the 125%

or do k3 visa and file i 134 and use assets for 100% poverty line?

We are very confused can someone explain to us the use of assets of a 401k clearly?

if we apply in october 2010 we will be using the current guidelines does anyone know exactly what they are?

any help would be greatly appreciated!!!!!

there is no 100 percent of poverty line on the I-134.

It's calculated at 125 percent, unless the USCitizen is a member of 'active duty military'.

Perhaps someone else can take a stab at explaining the use of assets on a 401 K ?
