I finally did it

After much knashing of teeth, I decided today to contact Senator Byrd's Washington DC office about Wes' AOS namecheck.

They returned my call within 15 minutes.

We are advised to write a brief letter, signed by Wes, about his situation and what we would like the Senator's office to do for us. Attach Wes' most recent NOA and fax it to them. A staff member will then contact a liaison to see what's going on.

I am told the FBI will not reveal any specific information (even adverse information) and indeed they may just say pending. They consider their job to be collection of the data and have no motivation to speed up that process, as the result of the check is not a priority to any of their investigations. It is a service they are hired to do and won't release the data till the service is performed.

We'll be writing our letter this weekend and faxing it on Monday.

next for us is poking our reps for our file as well. There is no reason why a WOM cannot be filed for a greencard applicant, there just isnt legislation to state the timeline as to when to do so. I suppose the WOM can have more strength when it has back up support showing all other avenues have been unsuccessful!

according to the FBI website information (i posted it on the name-check-pending thread), the name check can be expediated if it's requested by the agency involved. in other words, if USCIS would just ask, the FBI can and will expediate the name check.

i think perhaps this is the avenue you should pursue with the Senator's office.

Good luck with it Rebecca. We had to contact our representative about our NOA2s back during the visa process. We knew we were approved and that we needed the form for Craig's interview, but we never received it. They got on it almost immediately, and we got a copy of our NOA2 sent to us free of charge(since we never got the first) very soon after. Hope you get the same kind of help... M.

We contacted our Congressman 2 weeks ago and less than 1 week later found out that we were approved. They were extremely helpful. I am keeping my fingers crossed for you Rebecca!!!

We had a particular mental timeline of when we felt our 'D-day' was.

Our interview was 'early' (less than 4 months after filing) and particularly given that situation we believed that allowing an extra bit of time for the check to be completed was prudent.

Our office was very kind in giving us an e-mail address with which to keep in touch with them and have always responded to our inquiries. We have used that courtesy with economy as we felt patience would get us further than applying pressure.

However, D-Day is here. If we do not have the greencard by 10/1 we will need to file another EAD. We're just not really in the mood for that.

I consulted with a couple of my friends here on VJ and they felt we should not let this go on any longer, lest it fall into the 'black hole'. I hope our patience to date will be to our advantage in seeking a resolution now.

I faxed the letters this morning. Will keep you all posted.
