Previous K-1 causing problems?

His plan was to live in China but she wants to come to the US. He wants to live in China but she is pressuring him, he's afraid she'll leave him if she can't get her here. She's been helping her sister on match.com find an American so she can come to the US too so he thinks she would be able to do it also.

He already has his affidavit of support, nobody wanted to do it for him since he has a very bad track record with women fleecing him. This has ruined a couple of family relationships from the people he's asked and declined. My uncle eventually broke down and did it for him though.

He has no property or home in the States, he stays with me when he's back and uses my address for his mailing address. Is that a domicile problem?

He already contacted his senator or representative but it didn't help.

The only thing he sent me was a copy of a I-72 notice asking for a letter of hardship and proof. Transparency is not his forte. If I get more information or documents I'll let you know. Thank you everybody for your help and input.

Well, she's inadmissible for some reason and honestly this quoted bit really makes it look like he's a fool and she's a Greencard Shopper. How will he support his and her while living with you in the US? Are you both ready for when she decides to not return to China?

He has no plans as to how to support her except for me. He is collecting social security and expects her to get a job once she arrives. Honestly he is a fool, his last few relationships cost him dearly. The things he has done are so stupid, crazy, and illegal you'd think I was making them up so I won't get into it. He knows this and says he just wants to help her out so she can come to the US to make a better life for herself and her family (sister and parents). I think he's just trying to get her to stay with him as long as he can but knows she'll leave eventually. He expects that I'll help support her but I'll have to draw the line and not do it. He'll then probably disown me like my brother at that point, he hasn't spoken to my brother in over a year.

Helping him with this very difficult since I know it will only bring grief and hardship to me in the future, but he's still my father.

I've been reading this forum for a while helping my father bring his wife to the United States from China but now I'm stumped.

He had filed a K-1 visa two years ago but it was denied, he says it was because of the age difference (he's 66 and she's 29 now). After he got denied they got married and applied for a K-3 visa.

The K-3 visa was just recently denied and he was offered to fill out a I-601 hardship waiver. He tells me it is because they had already filled for a K-1 visa that is causing the problem.

He only applied for the k-1 once so I didn't think it would be a problem. Has anyone heard of this?

Reading about the I-601 tells me she is inadmissible for some reason, K-1? He says it's all because of the K-1 but i'm not sure if he told me everything or knows. Now he has to prove extreme hardship if she is unable to come to the US. Problem is he's retired and has moved all his money to china and lives there 8 months out of the year.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Well, it's approved. Very fast approval now, less than one month. He had me wire him 10k just before handing in the letter, i suspect he bribed someone that lead to such a fast outcome. I really thought it would take 6 months to hear back. Amazing.

I only hope he was not scammed out of his US$10K!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.
