Child Custody Issue - K2 in Juarez Mexico

Hi,

My fiance received her interview packet for her k2 visa interview in Juarez Mexico. Her 6 year old daughter will be coming with her to live in the U.S. (she is on the I129). The fathers name is on her daughters birth certificate, although he is not (nor has he been) active in her life. She (my fiancee) didn't want to attempt to find him so she started a case for sole custody of her daughter. Thanks to Mexico's great legal system the sole custody case is taking FOREVER. What is her other option for bringing her daughter in? Obviously she needs a Mexican Passport (which in order to get she needs the fathers signature if she doesn't have sole custody). Assuming she gets the Passport for her daughter, I know there is a letter of permission that the deadbeat dad signs stating that she can move permanently to the U.S.; does anyone have specifics on this process, or exactly what needs to be stated on this "permission slip"? Does it need to be notarized in Mexico?

The document we got for my daughter's biological father to sign was called a "Statutory Declaration", and we filled the form in ourselves and then had it notarized at a lawyer's office. This is what it said:

"I, (Father's Name), of (address), solemnly declare that: I give my permission for my daughter (daughter's name), date of birth (xx/xx/xxxx), to move to the United States of America to live with her mother, (mother's name), mother's date of birth (xx/xx/xxxx), of (address), effective immediately."

Her biological father went into the lawyer's office and signed the document.

I had to go back to court and get my custody docs to read "SOLE custody" - plus the judge added "Minor child can travel outside of Canada with mother" (or something along those lines)

Thank God I didn't have any trouble at court, heck I even filed myself!

I had my ex sign a letter of consent for the children to permanently relocate the US. We had it signed at a lawyers office and that was all I needed. Getting the letter is the easiest way. They never looked at our court documents that state we have joint custody etc. That paper was the only thing they cared about.

The signed letter is what they are looking for. My ex-husband and I had "joint" custody of my daughter, and they weren't interested in that part as much as the signed letter from her Dad giving his permission for her to move to the U.S. with me.
