Found this site called just answer..... It is a site for legal advice.... I asked my question and got a very simple and clear answer.... It has not fixed my problem but the answer I received has somehow eased my mind :0)Please see below the web page didn't copy the way it really should look. In april of this year my fiance had his interview for the k-1 visa in Casablanca, Morocco. Interviewer took our album of pics and told him he would receive a call in a few days. 3 days later he was called and asked to come back to the consulate at that time he was given a form which stated he was not elegiable for the visa and "OTHER" was checked as the reason. I was in Morocco at the time so I called the consulate but was told I needed to inquire by email so I did. I received a reply which stated our petition had been sent back to the states for further review. A few days ago I received the message below. I nned to know what does it mean and how should we proceed. Application Type: I129F , PETITION FOR FIANCE(E) Your Case Status: Post Decision Activity On July 12, 2010, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-XXX-XXX-XXXX. For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations. If you have questions or concerns about your application or the case status results listed above, or if you have not received a decision from USCIS within the current processing time listed*, please contact USCIS Customer Service at (XXX) XXX-XXXX. *Current processing times can be found on the USCIS website at www.uscis.gov under Check Processing Times. *** Please do not respond to this e-mail message. Unfortunately, it could mean any number of things, from basically them thinking that your relationship is not real or him being a terrorist or having terrorist ties or you being a danger to him if you have something negative in your background or it could be that he has something else in his background that they don't like. These are just examples I am giving. The problem is that you won't know until they finish reviewing the file. You will have an opportunity to respond then they do. I wish I could tell you how long it will take, but most of those types of cases take awhile because they are outside of the normal processing times. Contacting your Senator was a good move. If they haven't been too helpful, you can try contacting one of your U.S. Representatives as well. Hiring an attorney most likely will not push it along, but it may be a good idea for when the time comes to respond.

Another thing you could do is withdraw the K-1, go there, marry him and file for the K-3 process. The problem with that is that since you don't know why they are giving him a problem with the K-1, it may also be a problem with a K-3. So really the only thing you can do at this moment in time is wait or push your Senator or Representatives.

:0) Going back to marry was what I was planning to do. Actually it was what I wanted to do in the first place but was advised to go with th k-1. He has a brother and sister who both went through the k-1 process a couple of years ago but they both married white non-muslims (I am african-american and muslim) I was told I should have not worn my scarf in our pics do you think this had any thing to do with it? Unfortunately, there is no way to know until they come back with a response and like I said, if you try to withdraw the K-1 and marry and do the K-3 instead, there is no guarantee that you will not run into the same problem. Of course. That's why you are waiting. IF they deny, they have to let know why so that you can respond or appeal the decision. So they will let you know what the problem was IF they deny.

Basically you got the same answers from VJ members that answered your other posts, difference is you spent $30. There is no K3 visa anymore though, your legal adviser needs to update his notes. :whistle:

I sorta got the same answers here.... Just wasn't very clear because everyone has different explinations or you have this person saying that person is wrong....... And you you know even on the USCIS website when you do a search for the cr-1 forms info about the k-3 or I-130..... I it was nice to get an answer without sarcasm or someone making you feel stupid... For the most part I have a good experience here on VJ but there has ben a few folks that have replied to some of my pots and post of others with unnecessary sarcasm and attitude :0(

Hello, If your fiances brother and sister both did k-1 this could of also been the help for a denial because I do know that those are red flags and maybe it was that along with a combination of other things like the answers he gave etc. sometimes the co's just try to find any reason for denial.

We met through a website ( muslims4marriage) in Feburary of 2009. We both felt a connection right away :0) A few days after meeting and chating online Abdul asked me to marry him I accepted his proposal.

I can understand where this might have been a red flag.... But He and I communicated via video chat and email much longer than his siblings and their spouses.... As a matter of fact his sister and her husband only communicated a few months.... He went to morocco with a friend in like june and they met while he was there he went back home they communicated for awhile and he went back in august he filed the K-1 when he got back home and by march she was she was here in the states..... And the same for his brother except his brother and his wife started communicating a little sooner she was the friend that his sisters husband went to morocco with because she didn't want to go alone.... And what is even more insane is that their spouses were married to each other at one time....

Um, that is a lil creepy really. They married brother and sister and were married at the time. Ewww, are the brother and sister safe with these people? Almost sounds like a scam on this end not that end. Wowzer

His brother and sisters spouses were married to each other before, but at the time when they went to morocco they were divorced.... But she (brothers wife) didn't want to go alone so she asked him (sisters husband) to go with her.... I thought it was strange as well.... Even if they were divorced..... But they kept this from my hubby's brother and sister... Brothers wife didn't want them to know didn't tell him until it was time for him to go for his interview.... They aare safe.... Although brothers wife is a B***H to his brother.... And her Kids treat him badly ( her kids are adults)
