Timeline

OK I am trying to help a couple friends and need some advice...Me and my husband went through the k1 visa process and followed everything as we were suppose to and everything went well...We have met a couple people who just got married in the US. He is a US citizen and she is from the phillippines. She came over to visit and they got married. Now what do they do? They did not understand the process and now I need some advice from my trusty friends in visa journey...Please advice...I appreciate your help! Just want to help them figure things out...

Whether or not she intended to get married while she was visiting, she still has to exit the U.S. and they would have to proceed with a CR1 visa application. The VJ CR1/IR1 Guides would be very helpful to them (read about the process where the US citizen is in the US and the foreign spouse is in another country). She has to do this to avoid being denied, deported, or being banned from re-entering.

N-400 Timeline

02-23-2018: Sent N-400 Application online

02-23-2018: Date on NOA, retrieved from online account

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!

Not true...

It is illegal to plan to enter the US on a non-immigrant Visa with immigrant intent. If there was no immigrant intent at POE then it is legal to file for Adjustment of Status without her returning to the Philippines.

If she hid anything such as the true purpose of her visit at POE then she's on shaky ground. Otherwise just file AOS but she can't leave the US until she gets either AP or her Greencard.

The two met and fell in love....I have not known them long enough to even know how long she was here before they got married etc....They are calling me later so I can walk them through signing up for visa journey where they can ask the questions themselves...I know that visa journey was such a help when me and my husband went through the process. I just didn't know what advice to give these two....How does she prove she did not intend to marry when she crossed?

If they met and married in the usa she gets to stay in the usa while they are applied for her green card

That isn't so much the issue. It is impossible to prove a negative.

It is a matter of following the AOS procedures now that they are married. This is straightforward and many here have done so.

She can file for Adjustment of Status and stay here while doing it. The fact she has applied for AOS demonstrates her effort to stay here legally.

So even though she is out of status while applying, she is not going to get deported on that basis.

If she leaves, she does not have an automatic right to re-enter just because she married. She would still have to go through the approval process. So for most, it makes better sense to stay with your husband or wife while adjusting status.
