Hello everyone, I'm a dual Canadian/US citizen and I filed my husband's I-130 petition with Nebraska literally two days before I found out we could do a DCF :angry: . Anyhow - we received the first letter on November 30 after much waiting - the application had gone to California! - and lots of people here were very helpful in telling me not to freak out.

But now it's obviously February 18th and we haven't heard anything since - and from what I can tell from the online system nothing's been "touched" since November. Should I be freaking out? What can we do??

I filed my I-130 in August and heard nothing until the approval notice on january 25. it is normal not to hear anything.

No panic! I know it's easier said than done but you need to be patient when dealing with USCIS.

Thank you, I appreciate that very much. I'm nervous because we're supposed to move to the US in September and I don't know if everything will be ready by then!! If we even knew what we could do in the meantime while we're waiting that would be great, but I don't know what needs to be done. I imagine we need the police check and all that kind of stuff but I don't know if there are any forms or anything. I wish we could have just stopped that application and done the DCF here in Toronto but we were told it's too late since I'd already mailed the petition :( .

They dont always update the online case status for starters so I wouldnt be worried about that. They are only now processing petitions with a receipt date of 05 August 2005 for I-130 so there is a while yet before your receipt date of November. Hang in there.

Have a look at the Flowchart in the Guides section for CR-1 to get an idea of what the process will be once it is approved and reaches NVC. Then have a look at the link in my signature for Time Savers at NVC etc. This will give you the chance to get some of the forms they will require ready to submit.

Thank you so much for all that information. I'm really stressed out now though! I'm so scared that his application won't be ready in time for us to move in September. I really wish we could just cancel the petition and now do a DCF :(.

I was in the same situation as you. I had to move to the US before my wife was approved. My wife came down to "visit" while her Visa was processing. It only suckedbecause she was doing a lot of consulting work in Canada and had to fly back and forth all the time knowing she might be denied entry to the US but it never happened and everything was fine.

How terrible! I don't mean to sound naive about this - I knew it would be a long process - but I was really optimistic that we would have this all in the bag by no later than September! Ugh it's so frustrating, especially since I know now that we could have just done a Direct Consular Filing. It just wasn't an option when we were doing our planning.

You can visit this thread WAITING FOR I-130 APPROVAL FOR CR-1/IR-1 and you will find that the current waiting period for CSC is about 140 days after the NOA1. You are almost there....

Also, look at the NVC Flowchart for CR - IR cases to understand the NVC processing.

You can use either AussieWenches Time Savers for CR1 or Jame's James Shortcuts to save some time at the NVC.

I used James Shortcut's and completed my case in just 50 days at NVC.

Did you consider a K3 visa? It might bring you guys together quicker and should definitely be through by September.

Just in case the CR1 doesn't get through in time and you wanna make sure you can move to the states in September.

Normally I would say that your visa process should be finished by then but with immigration you can never be sure.

I did think about it initially but thought it wouldn't be necessary because for sure everything would be ready by September! I'm such a nerd. I wonder if it would be worth it now? There's also the concern about it taking so long for his work authorization to come through, so perhaps he should just stay here where at least he'll have an income? Thanks for the suggestion :).

I have not recieved anything from CSC after the I130 NOA1 and my reciept date was 07/21/05. All you can do is wait

Thanks for the tip! I've read through them as well as the tips you gave me before. I'm debating whether or not it would be a good idea for us because we're planning to move in September and it could actually be a bad thing to get approved too early because if I'm not mistaken you have a brief "window" in which to make the move! I need to figure out how long that window is first to make sure we don't get approved too quickly :).
