Any thoughts on what it might mean when I-129F is touched but I-130is not ?? This happened yesterday. It's been 5 and a half months since NOA-1. I'm thinking it could be the I-129F being discarded ?? or pinned ?

Well... you're married, right?? If so, you should let USCIS know and they will close your fiancé petition.. did you really file I-130 and I-129f at the same time? Were you married when you filed for them?

they filed for k3 not k1

Then what does she mean by her I-129f being touched or discarded??

sorry, I-129F is filed for a K-3 visa.

This is part of the K-3 visa forum, so is assumption (since the topic is here)

that the OP is inquiring about the I-129F that was filed for a K-3 visa.

Has nothing to do with K-1 visa or fiance, sorry.

----

MrandMrsE - my thoughts

with no touch prior, this being the first touch since it was submitted, then my best guess is that FINALLY there's some movement on the I-129F casefile.

5 1/2 months MAY MEAN it's being adjudicated, as it's 'in the window' for approval.

as to 'pinned or discarded' - sorry, unless you told USCIS to DISCARD the I-129F petition, it won't be discarded.

You could always call in to USCIS, get a Tier 2 Human, ISO - see http://www.dhs.gov/xabout/structure/gc_1221837986181.shtm#5 and inquire for casefile status on both of the petitions. If I were in yer shoes, I'd be doing this, today and tomorrow. Don't waste time with the first Human that you get, but do ask them to speak with an ISO.

When you have a moment, though - please review http://www.visajourney.com/news/2010/02/07/department-of-state-to-close-k-3-visas-if-i-129f-and-i-130-petitions-approved-and-received-together/

Good Luck !

FYI-touched again a few hours later. This time for the I-130.

It means your case is probably getting approved

Same thing happened for me last Friday (Sep. 17th). First 129F touched, then 130 touched ...

Found out the next day that NOA2 had been sent on the 17th. Keep checking the case status on Saturday. If you've signed up for notifications you should get an email/text message.

Good luck :)
