Good Day everyone!

This is my first post in this forum but I've been reading all your post since i filed my petition for my wife.

I filed my petition for my wife Jan. 2010, and we're approved and already have case number.

I have a 4 yrs old step daughter, can she come here in hawaii together with my wife?

You should have and have to file a seperate I-130 for your stepdaughter.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I think you can! By the way, is your wife already in the U.S. now or is she still in the Phils..? May I know when she was interviewed at the U.S. embassy in Manila? I filed a petition for my spouse too last april 2010 and got approved this month.Please let me know.. Thanks in advance.. =)

You should have and have to file a seperate I-130 for your stepdaughter.

There are certain conditions where seperate petitions are not required.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

She's still in the philippines, i just got the case number and i don't know when is the interview.

Yes! You can petition your step daughter too along with your wife but you will have to file separate documents for her too the same paper as you have petition for your wife G325 the Biographic form.Your wife just need proof of document like her Birth certificate. My husband did the same thing for me & my daughter.

Ya, you'll need to file a new I-130 on the child.

You could expedite this, if you want - see http://www.visajourney.com/forums/topic/255138-k3-k4-visa-converted-to-cr-1-by-national-visa-center/page__p__3918125#entry3918125 for a 'expedite packaging template' for the I-130 submittal.

I don't know if an expedite request works for an LPR filer, but I'm certain it works for a USC filer.

But it won't hurt to try, yes?

when you say 'approved' I must assume it's only the I-130 that's approved, yes?

The good part, is that you can 'go slow' at NVC, for NVC Processing, on yer wife's casefile, until the daughter's casefile catches up to the wife's casefile (which means I-130 approval, then lobbed over to NVC).

The timing will seem weird, but if you want them to interview together on same day, travel together, you should ask for the expedite on the daughter's case, and then 'go slow' at NVC on the wife's case, until the daughter's case shows up at NVC (then go fast).

You have 1 year to 'get it done' at NVC, so that's a plus when needing to 'go slow' at NVC.

If you didn't file a I-130 for your stepdaughter at the same time you will have problems unless your wife waits for her anaks interview and approval. Difficult to do if wife comes to the US.

For LRP's it is a little different when they file for the spouse. Here is some in in the guides about this read down to Following to join benifits. Guides

Please note: This section is only applicable to lawful permanent residents who did not gain their LPR status as the immediate relative of a U.S. citizen.

If you had children before you became a lawful permanent resident, and your children did not physically accompany you to the United States, and you would now like your children to join you in the United States, your children may be eligible for following-to-join benefits. This means that you do not have to submit a separate Form I-130, Petition for Alien Relative, for your children, and your children will not have to wait any extra time for a visa number to become available. In this case, you can simply notify a U.S. consulate that you are a lawful permanent resident so that your children can apply for immigrant visas. If, however, you immigrated to the U.S. as an immediate relative of a U.S. citizen who did not or could not petition for your children, you will need to file a separate I-130, Petition for Alien Relative.

Also you can ask some members here as they are going through or have done this already :)
